Can you obtain a license if you have a misdemeanor?

It is best to wait the full 5yrs so that you are not turned down without a review. You are allowed to submit earlier but it will be a waste of your time and that letter may have been a typo. I would check to see the model that South Carolina follows, most states go by NAIC model min 5yrs

it has been 7 yrs ive made my mistakes and have paid and suffered for years now i have been rehabilitated for 7 yrs minus a possession of maryjuana in 2010 im about to file for my license in the state of ohio to sell life and health insurance, what are my chances of being apprroved??? i have also had a few theft charges from way back in 2001 that i almost always forget about little stuff u know a pack of smokes or a drive off. i have served my time and paid my dues. Is there anything that will help my chances of obtaining it. im sick of being and working lowerclass jobs im the hardest working man there is i want my chance at success please help with any info thanks.

Theft offenses are among those under scrutiny, as are drug offenses. You won't know until you apply for a license and submit a 1033 Consent Waiver application.

i read something about being able to have a hearing to be judged if your fit for a license, is this possible for me to do incase i do get denied and how would i go about doing so, im a changed man and only want whats best for me and my lady. thanks for all the info

Hearings are at the discretion of the regulator. Under certain conditions, the regulator is not required to conduct a hearing and there is no right of appeal in those cases. You have to discuss the matter with the state Dept of Insurance.

I don't think your past drug conviction from 7 years ago will affect you getting licensed. I had a friend who had a misdemeanor charge for paraphanalia and got a massage license a couple years later with no problems. For anyone else wondering if they can get a license with a history of criminal convictions..it depends on the severity I'd guess..but why would you go through all that trouble when you can still sell discount healthcare benefits. It's not insurance, but you don't need a license and you're not restricted to selling it in one state. I just looked it up and it's available to all states except Alaska, Wyoming, Vermont, N.Dakota, S.Dakota, and Montana. Hope this helps. You can check my profile for more info.

Anything is possible. As long as you disclose it on our application you will have done the right thing at this time. If you are in doubt, call your state Department of Insurance and ask them. Each state treats misdemeanor convictions differently.



I've seen people with drug offenses such as possession of marijuana or misdemeanor assault obtain a license without so much as a question from the Dept of Insurance, while a person I know who pled no contest to a misdemeanor "lewd conduct" offense and has successfully completed three years of probation is being called to a public hearing because he has been deemed "unfit" to hold an insurance license. Go figure.

Had 2 felony larceny by employee charges. Deferred prosecution. Allowed charges to be dropped. Can I obtain license to sell insurance in North Carolina?

The answer depends on whether you have been CONVICTED or only charged. If you were never convicted, then you will probably not have any issues to resolve. But the crimes you committed would be of the type that are covered under the 18 USC 1033 prohibition if you were convicted.

If a person is a licensed insurance agent (Virginia) and they are convicted of a 1st time DUI offense, do they lose their license to sell insurance? If they don't lose their license, when are the companies with which the agent is appointed made aware of the conviction? Is it up to each company's rules if they are to pull the agent's appointment?

Most states and insurance companies require convictions to be reported immediately. A DUI conviction could result in a license suspension, but probably not a revocation unless there are other things in your past.



How an insurance company chooses to handle a conviction varies from company to company.



But one thing is certain . . . failure to disclose is far worse than the disclosure itself.

You must disclose all convictions after age 18. Will it hinder your ability to be licensed? Probably not, especially if you've kept your nose clean since then.
