Can you obtain a license to sell life and health insurance if you have a misdemeanor but no felonies in the past 10 years?

Did the judgment go against you? Anyway, this offense can't be considered under felony or misdemeanor. You need to obtain a criminal history report from the South Carolina Law Enforcement Division and submit it with the SC Dept. of Insurance after you have submitted your application.

Perhaps, you are going to get through considering the passage of time that elapsed and your health reasons. I'm not sure about the time-frame though. Let's see what the experts say...

So in a nutshell....if you have any convictions make sure to give plenty of info and just hope you are accepted? So it's a game of chance? Wish there was some way to know before I spend so much money to just be denied! Single mother can barely afford to take the test and now am worried I might lose out on over $200 almost done with class but wonder if I should even continue...offenses were 8 yrs ago no felonies but still a theft is on my record :( I was so hopeful to finally make something of myself

You haven't posted any information for anyone to give you an opinion. If you have no felony convictions, and your offenses are more than 5 years old, chances are your application will not be declined. But it's the regulator who makes the final determination. Before your application is denied, you would at least have to be given a hearing to determine whether you are "fit" to be licensed.

Each insurance company has its own criteria, so it's not possible to say what the ramifications might be. Were you only charged or have you been convicted? A DUI conviction is a reportable offense, but unless there are other issues not disclosed here, normally that alone would not cause a problem with one's license. A second offense within 1-3 years could be a problem.

I am trying to reapply for the states insurance license for the second time. I was denied 3 yrs ago because of my charges...one in 2001 and 2004. there has been no other convictions. im trying to get a pardon. do I have a chance at all?

ABSOLUTELY NOT!!

State insurance laws permit the Commissioner (Superintendent, or Director) to deny a new license application if a previous license application was denied within the past five years.

Even though your offenses occurred 9 and 12 years ago, the fact that your license application was denied 3 years ago is what will cause it to be denied again. If you wait at least two more years, you may have a chance.

Why did my letter tell me I could reapply in 2 years if state laws say 5 years? I live in South Carolina.

Well, maybe South Carolina has changed its law. Most states follow the NAIC model regulations which call for 5 years.

It is best to wait the full 5yrs so that you are not turned down without a review. You are allowed to submit earlier but it will be a waste of your time and that letter may have been a typo. I would check to see the model that South Carolina follows, most states go by NAIC model min 5yrs
