3 Cars in Accident

Guys,
Can you give me your opinions. This march I met with an accident and the claim is still open.. what do you think I can do

I was driving my car , the weather was raining and it was one lane road with 40 mph limit.

The accident took place in chain. There were three cars involved. A,B, C. Mine was the last car -C.

Now I dont know how the accident took place.. who was at fault. This is because I had a vast distance between mine car (C) and the second/middle car (B). But due to rain, my brakes didnot apply due to SLIPPERY ROADS and I banged into the front.

I see two possibilities,
1-- The accident of A&B took place first and I bang into them.
2-- the car infront of me was dead stop waiting for a turn ( Near by School) without indicators or something. And this was a one lane road.

Because I was the last person, the fault came on me. Luckily I would be only liable for damages to B as car A Incurred no damages

The witness ( third person) said that she had parked her car on the shoulders because the roads were too slippery. She says she didnot see who hit whom first.

It seems to me all accident drivers are saying a different story.

Whats your say.. Can anybody throw some light?

Looks like you already have your answer...If your carrier has paid for 'b's damages...and if it's still open that means someone also is claiming an injury...

If 'a' felt one impact, you are 100% at fault...if 'a' felt two impacts it means that 'b' hit 'a', then you hit 'b' knocking 'b' again into 'a'..in which case you would still be at fault for 100% of the rear damage to 'b' and some of 'b's front damage, and some (if any) damage to the rear of 'a'..


But sounds to me like your carrier has already accepted liability, so it really doesn't matter much what we think...is that correct?

Looking at the situation you have described, it looks that you were at fault because 1 was not damaged and it is U who banged into B

As I see to it in either cases you'd be at-fault for damaging the car in front of you.

IMO you're lucky that the first car of the line hasn't suffered from the impact, otherwise you'd have ended up paying for its damages too.

Yeah, the insurance says they will pay Car B and they dont need to pay to CAR A as there are no damages.

But I dont know why they have kept the claim open? What are they waiting for?

I already told you why...there's most likely an injury see my post above...

and if it's still open that means someone also is claiming an injury...

No, I was totally aware there is no injury.. the drivers had no impact, infact the accident was not a huge collision.

if they were in the car when you hit it, they felt an impact. The only reason the claim would be open is if they haven't completed the repairs to their vehicle, or there are injuries.

Ask any plantiff attorney.... a 5 MPH accident can cause at least 10K in injuries. :D

:lol: :lol: or an 'experienced' / 'professional claimant' Got one right now, one hour repair to the rear cover, and all kinds of hurt.. :roll: and an index hit a mile and a half long :roll: :roll:

I think the favorite that I had was a lady who ran up $21,600 in chiro bills and had $318.20 damage to the bumber of her car. Her excuse, I was just following my doctor's orders.
