soft tissue injury claim

Hello all,

I was in an accident in December of 2008. I was completely stopped at a red light and a guy plowed into the back of me without stopping. His car pushed my car into the car in front of me so I had damage to both ends. My car was completely totaled. I went to the hospital by ems from the scene. I had what the claims adjuster called "soft tissue" injuries. I was sent by my doctor to physical therapy for 3 weeks. I was treated like 6 or 7 times. I received money for reimbursement for a rental and what they called "market value" for my car. I got those about a month after the accident. I decided not to get an attorney since they admitted guilt up front. Now i'm in the "settlement" faze and the aduster offered me $3800. Out of that is $2100 medical bills and $950 lost wages. So that leaves $750 for pain, suffering, stress of not being able to get around and being so sore I could only lay on the couch all day for 2 weeks and i'm a single mother of 2. The ins guy assures me that this is fair because in "conservative" johnston co. nc they don't assign high value to "soft tissue" claims. Is this true? Is this offer a good offer or am I being swindled?

There is hardly a way to tell what your claim would worth. We have discussed it several times in this forum earlier also that the best person to judge the worth of claim is the claimant. But $750 sounds somewhat right to me for $2100 worth of medical bills.

However, just hand tight the adjusters would soon be on their way to solve your dilemma.

Some people apply the formula of 3 times the medical bills for pain and suffering claims. But that formula hardly has a ground. You probably have heard about the same method and that is why feel being swildled.
