| I got rear-ended. I was at a complete stop to make a right when the person behind me out of no where rear-ended me. It was to my understanding I was placed under my parents insurance when I recently purchased my car. But when I contacted my insurance to file the accident, I was told I wasn't insured. UM. Dilemma. The dealer I leased my car from said I was placed under parents insurance and that he would contact our insurance broker. I'm guessing that call wasn't made because out broker told me today I wasn't insured. Can i still get taken care of by the other party's insurance since it was completely their fault? Or do I need to be insured in order for the other party's insurance to take care of my damages? Am I at a total loss? Please help. Thank you. |

What make you think that you'll be placed under your parent's auto policy by default?
Sorry, it wasn't the financier's but your responsibility to get yourself enrolled under your parent's plan. Or your parents should have done it proactively if you have been driving their vehicle.

However, if the driver was cited for the accident, you are eligible to receive the compensation under his plan. Your insurance status may not affect your ability to collect for the damages. |

Well, yeah, you were required to be pro active to ensure yourself when you are driving. You should have asked your parents to add yourself to their policy. It wasn't the responsibility of the finance company.
Have you been included in your parent's policy before purchasing the car?

That may depend upon the severity of the damages. It'll depend upon the claim adjuster. And if your car has sustained enough damages then the adjuster might deemed it as totaled.
Have your car been inspected yet by the adjuster of the other party's insurance company?

Your lack of ins. shouldn't have anything to do with the other carrier handling your damages, unless of course that party is also uninsured..hmmmmm wouldn't that be somethin'? anyway file the claim with the at fault driver, hopefully you are insured now right? It's your responsiblity and no one elses...another thing..if this car is financed, your lein holder may have put collision and comp coverage on it, at a very very very high rate, you'd better check with them..before you get a bill for 2k...  _________________ "Never, never be afraid to do what's right, especially if the well being of a person or animal is at stake. Bad News first - I hear this so much..I thought I paid, I thougth I was covered, blah blah blah. Now, in your case, if you truly were under the wrong impression, then I won't be so hard on you. But...bottom line..it is ultimately your responsiblity to make sure you are covered. Even if you "thought" - one phone call would make it clear.
Good News - if the accident was in no way your fault, then your lack of insurance has no bearing on your car getting repaired.
Unless..like Lori said...the other guy was uninsured too.
