Can I be held Liable if I am on the title of a car with my father (Cosigned Title) and the car is in an accident and I am not involved in anyway/

Yes, as the owner you can be held liable. It depends mostly upon the state where the accident happened. A few state only allow the driver to be held liable for the use of the vehicle but many hold the owner responsible as well.

Since you are the co-owner of the car you may held responsible for damages caused to other drivers. But, as your father too is one the title, his insurance would act as the primary coverage for any damages caused by him. Your policy would play the supporting role.

OP....( putting in my '2 cents' again) I think since you ARE a Co-Owner, you agreed to take on the responsibility for any accidents, Insurance issues, etc.

What happens when both the father and son are not involved in it (suppose another person was driving the car..)? May be you're right..but I don't see the OP mention his father to have been involved in the mishap.

Insurance typcially stays with the car...so whomever is driving the vehicle (with permission implied or otherwise) the policy on the vehicle would take primary place...the owners of the vehicle likewise in most states can be held responsible as well (in an excess limit issue) right along with the driver.

I think there are couples of questions that need answering before we could reply to the OP....

Who is responsible for the accident? Has it actually happened or its a 'what if' situation?

Who is the primary lien holder in the loan document?

Is your father insured? Or are you the one maintaining coverage on the vehicle?

OP, as the above posters have mentioned, if its a third party claim then your being the co-signer wouldn't affect the claim process atall. No matter what, you'd be compensated by the at-fault driver's insurer for the damages caused to you.

My litle brother was driving the car when the accident occured, my father is the primary and yes my father is insured.
