Fair auto accident settlement

Not sure what a fair settlement would be. My car was struck from the rear during a chain reaction collision. I was stopped as was the vehicle behind me came to a stop but the semi behind her hit her car and pushed her into mine. Damages to my car were $5700 and it is being totalled. They claim the car is only worth $5190 due to the mileage. My car cannot be replaced for $5190 and it ran great. The car had a good mechanical history and had no current mechanical problems. For a 5 yeear old car it was in good condition physically and mechanically. I anticipate that my medical expenses will be between $2000-3000 for emergency room, xrays for my hand & ct scan for my neck with a diagnosis of a neck sprain and a tetanus shot for the abrasion. My auto insurance policy does not include medical. It happened on a Friday morning. Hence, I only missed one day of work (approx $200 in wages) and returned on Monday. I do not have a rental vehicle as of yet. I have had other family members drive me to work. What would be a reasonable accident settlement over here?

There is no way to tell this without having much more info. But I can say that your injuries appear to be non-permanent and soft tissue (meaning it's more of a soreness issue that will heal then anything else). Also it appears that most of your treatment was diagnostic in nature and not for the treatment of the injury. As such, I'd say that you probably won't be offered more then 1.5x -2x your treatment as a settlement.

Hello Stevensjuliet,

You haven't mentioned which state did the accident occur.

Anyway, damages to your car and injuries would be settled separately. So you need to handle them separately too.

However, What is the acv of the car? Have you checked with the sources like NADA to find out the acv of the vehicle?

Is your car still drivable?

If the damages are mainly facial /cosmetic with no severe interior damage you may check with the possibilities of retaining the car even.

Please try to reply to the questions I've asked and we can then discuss the issue further.
