Who decides which driver,One or Two....is in a non existing lane?

Hello....and welcome to the forum. Before 'we' can help in any way, can you please explain a bit more on the situation. Was there some kind of accident? 'Non-Existing Lane'? I've never heard of that, but, maybe someone else, on the forum, has. One of the 'experts', on this forum, will be along shortly, I'm sure. To help you out. Hang in there, please. :(

I was driver #1 driving on right and a driver(#2), was slightly to my feft and forward of me, as I glanced to my left and saw her "Right" turn signal on!I honked and she tapped her brake a brief second and came left into my car~which was shoved sideways over a 1foot curb off of road.Well 3 tires were off rd. and back left was down on street.It seems this road, in the 24 yrs. I've driven on it, has always been "1" lane each direction~but has never been Enforced as such.The Traffic Sgt. says the police report stateing I(#1), is primary cause of accident!!I am confused here~why was I in wrong and not her~especially since she hit me turning Right from left lane of cars?

Ok..thanks for the explanation. Well.......is there something that SAYS that was the ' Number 1' lane you were driving in? Why did you honk when she put her turn signal on? Also...I'm confused about something you stated. You said she was "left and foward of you." Then you said she "moved left and hit your car." If she was ALREADY left of you and then moved left, AGAIN, then she would be moving AWAY from you. I don't mean to sound harsh, I'm just wondering if I read your post wrong.

OK,I'm sorry...I meant she moved to her right and into MY left drivers side of My car....she was in an SUV and myself a Sable LS, and she was going to turn right onto street ahead.(You can only turn right, as that side street doesnt go left.)I honked repeatdly and hard in that few seconds, but she didnt hear me or stop! Her SUVs tailgate was about where my front left quarter panel and door jam are~she came into me and shoved me over.Who decides if she or I wasnt in the only one lane that it is supposed to be? And is it fair to judge and enforce a punishment on a driver who has drove that road that way for 24 yrs and never been told differently~same as with the other 99 1/2 % of the drivers here??

What left and right lane? That is the part you are ignoring.

If I understand this correctly, it's only one lane and you were slightly behind this other person. With that being said, she made the right turn from the correct (only) lane and you had started to pass her where there was no right lane to do so.

Perhaps it has been and you've just not seen it. It was inforced on the day of your accident.

It may well depend upon the state you're living in. driving law varies between the states. Hence, without more information its difficult to determine who's wrong. However, in most police report the driver marked as #1 is deemed to be at-fault and if that holds good then according to the law enforcer at least you are the driver responsible for the accident.

Thanks for the 'clarity'. It seems, TOO, that these two lanes 'merges' together ( maybe?) I don't know. But.........I see more of the 'picture' now. From what you're posting, it does SEEM like the other person was making a legal right-hand turn, into the lane.

Unfortunately OP you answered your own questions without realizing it...it's TRULY a one lane road...whether people ignor this or not is of no consequence, and I know what you mean by that I travel on roads like this daily...but it is enforced WHEN there is an accident...here's the crux of it...it's one lane...she's in front of you...so she has 'possession' of the one and only lane...she isn't making a right turn from the left lane she's making a right turn from the ONLY lane..based on the impact, again, she had possession of the 'the' lane, and began her turn...I understand your frustration, but it will deemed that you were attempting to pass her on the right of a one lane road...simple as that...now had you been in front of her and she actually 'passed' you and turned right different story...but of course this isn't what happened....sorry OP this one is going to be on you.

OK.........maybe I 'misunderstood' what she was saying. How many lanes there were, etc. I understood that there were TWO lanes and that the OTHER person was trying to turn into the RIGHT lane, into the 'original' person ( the one doing the posting). Ok....I get it now.

must be a wide one lane that people use as two lane especially at the intersection but is truly one lane other party was in front of OP and began their right turn in front of and to the left of (and striking) the OP...but when it comes down to it it's still LEGALLY a one lane road so the other driver had control (in front of OP)
