Thanks guys/gals for all your help.

I talked to my ins company today and they said that they will do the DV when they do the subro. I am bumming a ride off a family member at the moment. My ins company stated they will only give me $10 for loss of use and cover 80% for my rental.

For some reason, I have a feeling that I might be getting screwed on this. Am I being paranoid? Should I contact an attorney about this DV of my vehicle or do I have to take my ins company DV? Or did I mess up by filing with my ins company?

Man this is turning into a nightmare... Crying or Very sad

Well, I believe thats quite the last option...we should at least give our carrier a chance to go for subrogation & see if we have a way out of this situation. Yes, as the seniors have mentioned over here it is quite evident that the other party's carrier would stop the rental but they should be paying for the rental you've borne already. ArindamSenIndies

What is your rental coverage? and loss of use coverage? You need to check this...this is a payment option I've not heard of before, doesn't mean at all that your policy doesn't say this....check it out and let us know.

I have State Farm (the other party is Progressive). They stated to me that if I do not get a rental, I will get $10 a day for loss of use. If I do get a rental they will cover it at 80%. I then asked, why should I have to pay anything for the rental since it is the other parties fault. They told me if I filed with them then that is correct, but since I started a claim with my company they said this is all that is covered...

Yeah, I understand that...but what I meant was what does your policy say, regarding the rental coverage you purchased? Does it say that it's an 80% coverage?

I checked my paper work and it does say 80%. I guess I went cheap on the rental coverage.

yeah, that's what I thought...they cannot pay you more than the coverage you have so they are doing all they can....IF you decide to rent though and pay the 20% out of pocket ask them if they won't include that 20% as well in their subrogation demand and re-coup that for you as well...I'm pretty sure they will...''If'' you rent a car...otherwise I'm sure they will go for their 10 bucks a day along with your deductible...

Hey I don't remember if we asked or if you said, were you or any passengers in your vehicle injured? If so of course there will be an injury settlement down the line as will...that is TOTALLY separate from the vehicle damage claim.

Ask Progressive to send you a check for your deductible and direct bill your rental car. Most insurance companies will do this if you are going through your own company. It usually just takes a phone call from adjuster to adjuster to confirm your deductible and a phone call to the rental car company.

absolutely, or your carrier should go ahead and waiving your deductible since progressive has accepted liability...might be a small issue with the rental since you had that issue about the repair, but they should still pay for your rental without issue for the days it would've been down according to their sheet....the other can be fought out later between companies...

I just want to thank everyone for all the help.

I just spoke with the shop today and State Farm did give the go ahead to replace both quarter panels. Wow, all this drama and it is still getting replaced.

One last question. KBB states that my trade-in value is at 29,375 and private party sell at 32,345. When SF calls me next week about the diminished valued on my car it is based on the trade in value. Correct? Should I go out to a few Lexus dealers and ask how much they will give me for my car with the damage to rebut a low ball calculation from SF?

Yes, but what they owe you is the DIFFERENCE between what the value was prior to the wreck and after the repair..
