can someone please tell me how the insurance company figures out how much you are entitled to for pain and suffering? I suffered a fractured ankle that required sugery. I now have two scars and pain every day?

There is no hard and fast rule...they will take your age and health (prior to the accident) in to account, verses what it is now, and what is expected in the future....to come to a 'range'...of value for your injury.

Does this mean that a guy would have chances of obtaining more in terms of settlement for the same kinda injuries than someone younger to him?

Is that so? so far I though that only the injuries would affect the pain and suffering loss. Lori, please explain to us, how the age and health of the victim would affect his pain & suffering claim?

Well.....I'm not LORI (LOL :roll: ) but, maybe I can answer this question from my 'perspective'. I work with the Elderly ( told you that for a reason..). For Example: Let's say a 30 year broke his arm in an accident. Also..let's say that a 60 year old broke HIS arm in an accident. I would think a 30 year old would 'bounce back' (lack of a better word) alittle better because he/she isn't as 'fragile' as the 60 year old. Hope this example makes sense.
