I was in an auto accident in Dec.2008 and was injuried with back, neck, and eg injuries. I had to have therapy, no copay. Copay to the M.D. was made. I have just finished therapy. My car was repair and claim for car settled. I do not want to pay an attorney if I can process this claim myself.

I will have to sleep on a contour mattress to ease my sleeping pain and misery. They also want me to sleep with a contour pillow, all of which costs around $3000. They consider this soft-tissue injuries, what is a targeted range to ask for settlement? Thanks!

Without knowing at least the exact extent of injury, amount of medicals and type of treatment it is impossible for anyone to offer a ballpark guess. I can see them questioning the matress and pillow for 3K.

I WILL ALWAYS HAVE TROUBLE WITH MY BACK. I HAVE TO BE CAREFUL HOW I MOVE OR PICK UP THINGS OR TURN FROM POSITION TO POSITION. NOTHING IS BROKEN! MY NECK HAS A NAGGING PAIN IF I DON'T SLEEP ON THE CONTOUR PILLOW. MY LEG HURTS DAILY AND I HAVE TO HAVE SHOTS FOR IT. I HOPE THIS HELPS!

My daughter was recently in an accident with me and received soft tissue injuries. Usually they do not settle for a high amount. Hers was $3000 and her medical bills were $1500. Even getting that amount was like pulling teeth.

Your case may be different since you have lifetime injuries. Hopefully someone here can help you figure out a good value. Getting an atty is expensive..33 1/3. It really was not worth it for her case but they were also handling mine..wish I would have found this place first.

Attorneys who share the claim value are the best in such circumstances. They have the expertise and knowledge of making small money big and as long as they share with the proceeeds and fetch more than what you could get otherwise you should be happy.

How much were your medical bills? Of the bills, how much was for treatment and how much was for tests.

I have to disagree a bit with Neetalia. I had an atty for my daughter and unless you have a lot of medical bills and ongoing problems from the wreck a soft tissue injury will not yeild a big settlement. They say it does not go by medical bills but when they did my daughters case the atty kept harping on the fact it would have helped if there had been more bills. This really aggravated me and I let them know. It was like they wanted her to be hurt more. I do not think atty always have the best interests in mind for their clients.

Dasfuk, can you please explain your reason for asking the above question? How can the amounts possibly affect the claim?

The amount of medical bills coupled with the type of injury, extent of injury and any permanent injury always come into play. The amount of bills is not the only factor regarding settlement but is one tool in helping to come to an amount. (If someone runs up 10K in MRI bills with limited treatment, not really helping their settlement amount.)

Your injury is a workers' compensation loss. You will be compensated according to state law.

You should get medical and other benefits under your state's Worker's Compensation insurance program. Regardless of who was at fault, you should have immediately informed your employer about the accident so that they could take necessary steps after consulting the insurance provider. For up-to-date information on workers' compensation in your state, contact your state's workers' compensation office.
