Accident with police report but no ticket

Hello,

A couple of months back while I was waiting for a school bus to pass a lady hit my car (driver side door) while pulling from her parking. I decided to wait for the police to get a report but the officer did not give her a ticket. Because she wanted to pay for the repair the office said that as long as we handled it out of pocket the report was meaningless. Now when i give her the estimate she telling me she is not at fault because the officer did not give her a ticket.

On the report her information is listed on top.

Is this true?
Can I take her to small claims court
Can i go to the insurance and make a claim?

I'm guessing the officer gave you an exchange for but filed no report?

A person not getting a citation does not mean they were not at fault. It's the offers discretion as to a citation being issued and this does not change what happened... and it's what happened that determines liability.

If the offer gave you an exchange form then it should have the other person's insurance information listed and/or they were required to give you this at the time of the accident. Contact her carrier and file a claim. If you were not given this info, contact the officer that told you he would not be taking a report and tell him that the other person is refusing their insurance info and see if he can provide assistance.

Thanks for the reply. I do have all her insurance info. When the office did the report we did have to provide DLInsuranceRegistration.

On the report, under contributing circumstances, one of you will be listed on what the cause was. Or his narative will state his opinion. Based on your statement and the other driver's (if taken), the insurers will make a decision of liability. Report it to your carrier along with the report, and make a claim with her carrier. Then, wait.
