How to cash auto insurance claims checks?

The procedure of cashing out a check may vary from one company to another and if you are cashing out a check you may call the issuing company to ask what their requirement is to cash the settlement check.

Here are few steps you may follow:
  • You may call your lien holder or the bank and let them know that you have received the check for insurance settlement and that it is payable to the policy holder and the company.
  • Get your check endorsed and ask the company to endorse their check too. You can find out from the lien holder which department you need to send their check to. After getting it endorsed the company will send back the check to you. If there are any other payees on the check they must get the check endorsed too, even if it is your spouse.
  • After the lien holder and other related people have endorsed the check you must deposit it in your bank account.
  • Wait for clearance and then you may issue your personal check to your lien holder who you owe money. It may be your auto repair shop or the contractor who has got your home repaired or any other related person or company.
  • If your check amount is large some banks may require you to produce a report for insurance loss and also the bid placed by a contractor or a body shop for which you need to make the payment.

Is it difficult to cash an auto settlement check if your car is repoed?

Not if the check is in your name and the lien holder's. But if the insurance company has put the check in the name of the lien holder you might have a little difficulty in getting the balance amount back. They might give you a proposal to get the car repaired and use up the balance amount you think you deserve. If this is the case, you may contact them and ask them what procedure they follow after you have endorsed a check and mail it to them.

If your car is repoed, you may contact the lender and try to negotiate a payment option. Repossessing your car is not the best option for your lender since they lose out thousands of dollars doing this. So, usually they would like to work out a payment plan with you and try to prevent their loss.

When you sign an agreement document with your lender you must first go through the terms mentioned in the document. It is supposed to have rights you possess in case you default on a payment or if your car is repossessed. Make sure you know your rights and be aware to not be fooled in to any action taken against you that is not legal.

You will not get in trouble if your leinholder reimburses you the difference (the amount that is remaining on your auto insurance claim checks after subtracting the $900 owed to the lien holder), which is highly unlikely...but if you only owe them 900 then they will have to...unless they want to get the vehicle repaired that is...you need to contact them and ask what is the process if you endorce it and mail it to them will they in turn return the balance...do not even think about trying to forge their name to the draft.

You are required to inform the lien holder about the auto insurance claim checks, since their name is mentioned in it.

However, I guess you may not have a problem in retaining the balance amount after paying the due to the financier.

It's a practice to include the lien holder's name in the claim check, when there is an amount due on the car. And in such cases you are required to involve the lien holder in the claim process. They may want you to mail the auto insurance claim checks to them or may allow you to en cash the check and pay their dues. You are required to find it out by calling up the lien holder's office.

if I was the only one listed in the auto insurance claim checks, i would go ahead and cash it, but of course pay back what I owe.

well this is the deal , i owe them 1399.00 she says that i need to pay for a repo fee that consist of 440.00 so the check is 2000.00 and that will leave 80 or so dollars..and the guy that actually made repairs i owe him 700 .. the bank say oh well and if i don't give them the check they will have my insurance reissue it to them , but the charges for the vehicle are 1400 so what will happen to the other 400? any help is greatly appreciated

Ok, I think you need to start at the very beginning...If it was re-po'd how is it in the shop and how can you owe money for the repair? Ever car I've ever seen re-popped, the car was gone, taken back to the leinholder...and eventually sold, then the defaulter (you) was still required to pay whatever balance there was to clear the note...

So lets start at square one....you stopped making payments when? The car was in an accident when? The claims draft was paid to whom and when? The vehicle was re-po'ed but not really? Why do you have access to the vehicle...

You owe the bank exactly how much to clear the note and get the car back? You owe the mechanic how much? Do you still have insurance on this vehicle?

ok from the beginning...
august07 i backed into a pole , minor damages to the back of the vehicle ...it took till janurary08 to get the adjuster to come and look at the vehicle and get the claims check generated, during the time in between we had a hit and run on another vechicle we own, the insurance got the two vehicles mixed up and we had issues trying to get correct information. i had a friend whose husband is a mechanic, my vehiclc was drivable but not safe to drive , he said he would do the repairs to make it safe to drive , as long as when i got the auto insurance claim checks i took it to the shop where he work to get the rest repaired and then he would just add what i already owed to whatever the rest of the repairs cost..the repairs he made to make the vehicle (safe)drivable equaled out to 700.00, fast forward to jan. the check is mailed , my neighbors where illegally going in all the neighbors mailboxes including mine , check went missing 1 week later the bank came and got my vehicle involuntary , i was behind by two payments i have a 2year old and was 6 months pregnant with my second, the doctor took me off of work due to being high risk pregnancy and i had just found out my child was diagnosis with tre-18 , the babies usually die before birth or within a few hour after birth , i also had to get my cervix sewn shut b/c of pre-term labor with an incompetent cervix, i had no money to care for my child nor pay bills , so that is why the car got repoed..the insurance company just call august 08 said they would re send claims check , so i thought ok , i will give the bank whatever was owed to them and pay the mechanic since he has called almost night and day for the last 6 months . well i call the bank and i am told i owe nothing then later that day , the loan (shark) representive calls me and say hey you have a claims check well it belongs to us , now that we have the vehicle and she stated the damages where 1200 .00 she then asked how much the check was and i stated almost 2000.00 well she said she need to get the right amount that was owed and call me back , she called back next day and said it cost them 1400.00 and the legal department said i also needed to pay the 440.00 repo fee along with it , she laughed stated that only left 80.00 left to pay the mechanic , but said she would try to work on getting him more money but didn't know how she would be able to since the legal department there said the whole check belong to them .. i am very confused and don't know what to do, i have a invoice from the mech. and i still have the claim's check , how can the bank charge a repo fee and have the right to pay for it with an insurance claims check? what can i do , i am a young mother that many take for as naive, i've already lost on my credit report , i don't want to lose anything else or have to go to court b/c of mech. fee for parts and labor i haven't paid for yet b/c of all this, i just want to do whats right for the bank and the mech. i do not know how much i owe on the car , she told me the legal department has to deal with that and request that info from the vault , no i don't have insurance on the vehicle still , when they repoed it that day i called and took it off of my insurance , the mech is owed 775.14 exactly.. the bank rep treats me like a piece of crap b/c i am a single mother who could not afford to keep her car b/c i chose to keep my child and do what was necessery for her to be here, i appreciate anything and everything you help me with ..god bless you.. i am sorry if i didn't explain enough the first couple times i wrote i was trying to hurry and write and didnt know exactly how open to be about this

That is five months! how is that possible? Did you have anything to do with this delay? What possible reason could there be for this delay? This is bad bad bad business and bad faith...let me know the reasons behind this....you may have a bigger claim... :roll:

Ok so the bank is saying they will give the car back and clear you account basically for the ins draft is that right? I understand you would still owe the mechanic, but you would have your car back and not owe anything is that right?

They don't car where the money comes from as long as they get it...they have to pay the re=po guy so that sounds reasonable...if they will totally clear your account and give you paid off title with that 2k draft...i think you should do it...in person though...

Well do you owe years or months? If you can't get a clear title, (and sounds like you can't maybe) then I'd call the adjuster, tell them you had some temporary repairs done, here is the bill and maybe the mechanic can give you a mechanic lein...ask if you can return this draft, and they issue the 700 direct to the mechanic and the balance directly to the leinholder...you won't have a car, but you will be done with it...

That's bull....is this a 'buy here pay here' kind of place or an actual bank or finance company? what is the name of the lein holder?

that's fine honey let's just try and sort it all out...you do not have the car the lein holder does right? have they tried to sell it yet? what is the year and make? let us know all of that and the state you are in and i think perhaps your carrier can re-issue the drafts...

okay i will start here: trisomy-18 is a genetic condintion, and its rare, tre-21 is down syndrome, trisomy-18 is the second most common chromosomal defect , trisomy 13 and trisomy 18 are usually lethal conditions in which over 95% of babies born with these conditions die within the first year. at conception 23 chomo. form the father and 23 chromo. from the mother combine to make 46 chromo. in each cell , two of each type, each chromo holds a particular positon in the cell and carries certain genetic material , a trisomy occurs when a baby has three chromo in one position insted of the normal two, the most common trisomy is down sydrome . trisomy 18 is also call the edwards sydrome ..........it occurs in 1:3000 live births , unlike down sydrome tri-18 is usually and always fatal with most babies dying before birth and thse who do make it to birth tyically living only a few days , however a small number of babies 10% live alteast one year. 95% of trisomies are full trisomies , that is an extra chromo. for ever cell in the body, this trisomies is not herediarty and is not due to anything the parents did or diddn't do.. trisomy -18 usually always have heart defects such as vsd(venticular septal defect-

a hole between the lower chambers of the heart and coarctation of the arorta ( a narrowing of the exit vessel from the heart) kidney abnormalities, omphalocele (a portion of the intestinal tract is located outside the stomach in a sac), esophageal atresia (the esophagus does not connect to the stomach, meaning the baby cannot eat by mouth), and polyhydramnios (excess amniotic fluid), clenched hands, choroid plexus cysts (a pocket of fluid on the brain that is not problematic in itself but may be a marker for Trisomy 18), rocker bottom feet, and delayed growth, micrognathia (small jaw), low-set ears, and a strawberry-shaped head, as well as severe developmental..

that sums that up , hope i expalin it well enough, by the way my daughter is 4 months old and doing well she will be 5 months the 22nd of this month ..
now the issue with the car the only bill i have for the car is 15999.00 this is what was sent to me after they repoed the car , if i want the car back i must pay 16000.00 plus 440.00 for the repo fee, Not going to happen even if i could afford it , the bank is peoples first , and the car dealership was cook whitehead ford..both places are ripp off anyways...so basically i can't get my car back, peoples first bank owns it now and they put it in their shop , i still don't understand why it hasn't been auction off yet they repoed it in jan 08 and they said they have just now got it repaired and are getting ready to resell it.. i am in Florida.. what can i do , i need to get this settled by tomorrow, she already stated that she is just going to call the insurance and have them void out this check and re-issued one to her and people first , i don't have an issues with paying the 1399.00 for the repairs ,but can she really add 440.00 for the repo fee and take the total check ? thank you very much for your time and effort ..god bless

Well yes, she can take the whole check, because you owe them 16k...doesn't matter about the repairs...anything additional above the repairs they will subtract from what you owe...If I were you honey, I'd give the car repair guy all the information on the loan company, and tell him to quickly file a mechanics lein against the sale...that way they have to pay him from the proceeds...now granted they are going to sell this car and still claim you owe them the balance, (and you will)...but the old saying, 'you can't get blood from a turnip' applies here...
