Please somebody help me.. Accident turned bad

Hello. I'm insured under Geico and I've been in an accident long time ago. Well, I ended up going to the hospital for x-rays (right after the accident) and fines were taken care of (ambulance/etc) except for one!

This fine was over a $1500 and I thought Geico took care of it cause I remember faxing documents and letters to them. Well, it's been a long time (almost 1yr) and I get a letter from West Asset Management saying that "Your account has been turned over to us for collection."

Is it too late for my claims adjuster to help me pay for this fine?

I talked to someone at West Asset Management and he told me that it's going to be hard to resolve this.

sigh. I can't pay for the fine cause I can't make enough money (I'm trying my best to get more hours or a 2nd job). If my mother finds out that I have to pay for everything then I'm screwed..

Not sure where you are located as you call it a "fine" and not a "bill". Are you in the US? If so, what state... as the statute of limitations might apply to the collection.

You also need to contact your carrier and let them now of the bill. They should be able to address it if it's still owed.

I live in GA. I'm going to try to have the collection company not ruin my credit..

it's great that you've put what state you're from... I just read that the statute of Limitations for personal injury in Ga is 2yrs... so you should be good to go :)

A point to consider (and I'm just trying to be honest not burst your bubble)...is that your Geico Policy may have limits on Medical Bills that are paid because of an accident... You should contact your adjuster ASAP to figure out why that particular bill wasn't paid. If it was an oversight or what happened...

From what I understood GA got rid of PIP many, many years ago. When did the accident happen?

nayyb, that applies to 3rd party liability claims. This is a 1st party claim as the OP stated GEICO was his own carrier.

Yup, Georgia isn't a PIP mandatory state but one may add med-pay and/or PIP coverage to his/her policy.

Trist, have you tried to find out why this particular bill wasn't paid? At times if the doctor's office fail to file the claim on time the insurer might deny to acknowledge it.

Hi natyb,

It's good that Trist followed it with Geico right then. It would have been better had he recalled what happened after that.

It's important to remember that whenever a collection agency makes a collection effort they'd need to send a notice to you regarding the details of your debt. Now under the FDCPA, you'd have 30 days time to dispute the debt validity fully or partly from the day when the notice was served to you.

Nope shouldn't be...did you have health insurance as well?

I SUCCESSFULLY got our health carrier to back up and pay a hospital bill for my daughter that was eight years old that we all thought had been paid...it surfaced when she was going to close on buying a house! Took me a little time, but I got them to pay it...

Don't give up call the adjuster NOW...and if you haven't exausted your medpay then you should be ok...again any health insurance?

ps..what's mom got to do with this? weren't you 18 or over when this accident happened?

Thank you everyone. I'm trying to contact my claims adjuster, already left 2 voicemails.

And sadly, I do not have health insurance..

I talked to a guy who's watching over my account(?) at West Asset Management (collection). He said he'll talk to their insurance company (or insurance part of the company?) and try to resolve the debt by contacting Geico.. hmmm.

In the end, will my credit be ruined? Can I argue or something to save my credit?

I need a miracle.

Any account that's into collection would appear in your credit report and therefore is likely to affect your score as well.

Trist, I'd suggest the same...don't give up yet. Contact the adjuster and see if there is still a scope for you.
