just need some advice

So i just got into an accident. My vehicle was the only one involved (and a deer) but i flipped my vehicle. When the police called to verify my insurance my company said i was covered and everything would be taken care of. Yet when i called they told me that my policy had been canceled a few weeks earlier. The police towed my vehicle. I'm not really sure what to do in this situation. Am I going to have pay for everything? Either way I don't see myself having a choice I need my vehicle but i was just wondering if anyone had any suggestions. Thanks

Do you have any proofs with (any receipt) you the last time you paid for the premium of the insurance company if you have the one with you and if it valid then you need not fear.

BUT if your policy is lapsed then you can hardly do anything is this regard.Rather there won't be any useful outcome even if you try to fight a battle if your policy is lapsed due to non- payment of premium on time.

But if your policy is not lapsed then please answer on this forum and then you will surely get help in this regard from us.

From what you say, it seems your insurer had not informed you about your policy being canceled. But the legal thing is that before an insurance company cancels any policy, it has to inform the policyhodler way before time (at least a month). No insurance company can simply cancel your policy without informing you. Speak to the executives at the insurance company.

I pay for my insurance straight out of my bank account. I checked last night and found that it says on there that the last time I paid was April 1st. I didn't receive any notice that my insurance was going to be canceled. thank you for your help.

Another thing I'd suggest you do is go through your policy papers to find out if you have unknowingly (or knowingly) agreed to some clause in your policy that states your policy can be canceled without prior notice (the presence of such a clause is dim but still...) If you don't find any such thing in your policy you can then challenge the insurance company. I am saying this just so that you are sure when you call your insurer.

You have a receipt for the premium that you have paid in April. Based on the condition of your car, your insurance company must pay. Even if it is totaled, you are bound to get the ACV minus the deductibles. So ask them what they plan to do about it.

However, on what grounds is your insurance company canceling your policy? Have they stated anything?

My car isn't totaled. I think it can be fixed. I'm going to take it back to the dealership next week. I figured that was my best bet. The insurance company didn't give me a reason at first however i just received an email from them yesterday stating that it was canceled due to none payment. but i don't understand how that could have happened. i will read over my policy tonight and see what it says. thank you for your help everyone.

non-payment? didn't you say that the amount was deducted directly from your bank? double check with your bank, and make sure that payment was defaulted, and find the reason why.

since you mentioned that the last payment was made on 1st april, call your insurance company and find out why they did not recieve the payment (i assume that they cancelled your policy because of defaulted payment).

yes, read through your policy again and let us know more.

i suppose that the accident took place well after april 1st.If that is the case then your insurance company do not have any right to cancel the insurance policy without giving any notice to you.

But if your payment is a late payment ( not a regular ) and you have paid it only after the due date then this could be a tricky situation for you.

You have your bank statement and checks to prove you made your payment. So show them to the insurance company. It is not your responsibility if they have misplaced a payment or 'misused' a payment. If you have paid your premiums you will get coverage.

I'm going to take it back to the dealership next week.



Get an estimate of how much it would cost to get your car repaired. Remember, if you pay out-of-pocket, you may not be reimbursed by your insurer later. First show them proof of your payment and get them to resolve the matter. This is my suggestion.

Under pretty many circumstances their records would show the date when a mail had been dispatched. They'd always argue that it's the policyholder's responsibility to stay updated regarding the status of his coverage. Again, they'd definitely deny payments once you pay out-of-pocket.

Buddy, I think its time to move up the ladder and talk to the premier of the company. Some how the whole thing seems shady to me. First you were told that you are covered but now it seems that you weren't. :? Whom you have been dealing with so far?

I agree with Steven that its the responsibility of the insured to stay current with his policy but again you have paid them on time, right? And, yeah, pls check in the policy paper whether you atall had comprehensive coverage on the vehicle.
