Involved in a no fault

Involved in a no fault traffic accident. My insurance unfortunately lapsed 8 days ago. Will the other driver's insurance pay for the repair of my vehicle & rental? Or will they give me a hard time for no insurance? How will I be held liable?

Most likely thay will pay with no problems. Some states are "no pay, no play" states but this only applies to non-economic losses (meaning if you don't have insurance in those states, you cannot collect for things like pain and suffering on injury claims). Payment for property damage is still covered.

Well, as tcope has mentioned, if you're not residing in a ‘no pay no play' state you might not experience issues in recovering for the claims. Louisiana is one such state where this rule applies.

The ‘no pay no play' statue forbids an uninsured motorist form collecting benefits from other driver's policy, or may put some restrictions on the amount receivable for the damages. The statue may well apply for both the injury and the property damage claims. Hence, you'd be out-of-luck if such clause applies to your state.

Though no-insurance doesn't restrict you from seeking compensation from the at-fault driver's insurer, but you may well agree that with a lapsed policy you shouldn't have been on the road.

PA is not a no pay no play state.

Also, I don't know of any no pay no play state that bars economic losses, such as property damage. About the only thing it bars are general damages (pain and suffering).

Assuming it is clear 100% liabilitly/negligence on the other party you shouldn't have any trouble...what I want to know is do you have insurance now?

In PA, there is a 'TOUGH' penality for driving without insurance. You CAN/WILL pay a HEFTY fine, you CAN lose your DL, etc. I'll tell ya, ..I don't think it would be worth the 'risk' to drive without insurance. Why did your insurance lapse? Just curious.

There really is a tough penalty in place here in PA and I can not say a bad thing about it. No one has the right to go out on the highway without insuracne and cause havoc to someone elses life. The best policy I seen put into place in PA was when if you drop your insurance you best either 1. prove you have new insurance or 2. mail in the plates. It at least helps keep some of the non insurance paying people off the highway. I can understand the "no pay, no play" for pain and suffering.

YEP______I've actually know Highway Patrolmen 'impound' cars if you are driving without Insurance!! Gosh...that sure isn't the risk I would want to take!! Can you PM me, FIREYONE and tell me WHERE, in PA, do you live ( just wondering).

Sure I will pm you. I am glad to hear they do that also. You may find that I am a little hard on uninsured drivers but I have seen first hand and second hand what they can do to a persons life. It is just that to me insurance is as important as putting food on the table. If you don;t carry it and hit someone you can really mess up a persons life.
