Hello Cher,

I’d not ask you why your daughter was driving without coverage, but, yeah, he must compensate the other driver for his damages.

driver wants us to pay his deductable nd bumper repairs,

If he turns the claim to his insurer, they would pay for his damages and then would subrogate against you for the loss they have paid including his deductibles.

In the State of Texas, if your husband is found at fault for the accident he is facing license suspension until the judgment is paid in full (if a judgment is filed). In addition, he may be required to carry an SR22a, meaning he will have to pay for insurance in full, cash, for a minimum of six months. Also, with the passage of the Driver Responsibility Act back in 2003, he will be required to pay a $250 a year fine for 3 years in addition to the no-insurance fine the county imposes. And yes, you will be required to show proof of insurance to get the car out of the impound lot.

As stated in previous posts, it's much cheaper just to buy the insurance in the first place or to use alternate means of transportation.

I was the uninsured motorist due to mishap with my insurance company at the time of the accident. The officer recored the policy# wrong on the police report and I received a new policy on the same day.

Am I responsible for the other person's vehicle since they hit me but I was uninsured? What can I expect?

I'm sorry we missed your post... Embarassed

First of all ring that grand daughters neck! Mad Most importantly is do NOT hide from the carrier...secondly, I've got a few questions to better understand the situation and provide help you'll need to answer them:
>Do you have insurance on any other vehicle?
>If so, contact that carrier and see if they will afford coverage, (i highly doubt it but worth a shot)..
>does your grand daughter live with you ?
>if not who does she live with?
>Is she a minor?
>What state are you in?
>how long ago was it?
>when did she tell you about it? I'm sure she has received letters as well, did she tell you when she got them?
>What EXACTLY happened in the loss?
>Did she have any passengers in the vehicle?
>Are there any injuries claimed?

You'll need to contact the carrier and set up a payment plan...IF your grand daughter was 100% liable for this loss...

I don't understand this statement or what it has to do with the accident or your lack of insurance, would you please clear this up?

If you were at fault yes, if you were not at fault, then no.

my husband was in an accident with one other vehicle @ the time of the accident he did not know that the insurance was lapsed (I am the one that pays the insurance) he had called me (did not tell me he was in the accident) wanted to know where the new cards were and the policy number (because he has a new job that requires insurance) right after getting off the phone I called the insurance and got it reinstated. Needless to say when my husband came home later that day I found out that he was in an accident on his lunch break. I then had to tell him that at the time we werent insured. My question is, what is going to happen. We have insurance now but didnt at the time. What are we supposed to do? is he going to lose is drivers licesne?

You are going to be held responsible for the damage of the other person (if your husband was at fault) just as if you had insurance.

Possible but unlikely if you reported to the police that you had insurance and could produce a valid policy. Once the other person finds out you did not have insurance they could report this to the PD and it's possible that the state may suspend your husbands license until he can confirm that the other person's loss was addressed.

he did not give them the policy number or card cause he had just changed walets so he didn't have it with him, he just told them who it was with, and the officer gave him a form that is supposed to be filled out by the insurance

I did call my insurance today and told them about the accident and from the info on the accident repor the owner of the other vehicle stated that they also used the same insurance company as us, and they have not filed a claim. how long do they have to file one?

Depends on the statute of limitations in your state. Could be anywhere from 1-4 years.

It is highly unlikely that your husband will lose his driver license as a result of this incident. But he could certainly be subject to a citation for failing to have insurance, since that is an offense in almost every state. Not to mention the loss of his employment for not having insurance as required.

Your husband should contact the other party and settle the matter privately. It will probably come out of your allowance for the next few years.
