My insurance company sold me a name non-owner policy because I do not own a car and have to have an sr22. They knew that I lived w/my boyfriend and that he has 3 cars at this address. Come to find out, I really am not allowed to have this policy for this reason. A name non-owner policy is meant for people that do not have regular access to a vehicle. Having 3 cars here, I obviously have access to 3 cars. I told my insurance company that I wanted to cancel the policy and expected to be reimbursed for the money I have paid them (minus the cost of the sr22 filing) seeing as if I would've gotten into an accident while driving one of those cars, my insurance wouldn't mean anything. They basically refused. I am wondering if I am able to sue them for at least the money that I paid and what type of lawyer would handle this type of case.

When you filled out the application it did not ask this type of question? I think perhaps it did. How did they find out about the other vehicles?

If you had disclosed while applying for policy that you are staying with your boyfriend and he has 3 cars ,then the insurance company shouldn't have sold the non-owner policy .I think you are right in your complaint and can probably sue the insurance company.Regarding the lawyers I think the moderators need to step in to help you out..

I did list the 3 vehicles on the papers they sent me to sign. I even called the company to ask if I needed to list the VIN #s and they told me not to because I was not actually insuring the cars. I also gave them the scenario "if I drive one of his cars and get into an accident, how will that affect his insurance?" They told me it would not affect his insurance at all.

I seriously doubt they will refund any money other than from the date you cancel it as you had coverage (on other vehicles) during that time frame...

I didn't have coverage on other vehicles, my boyfriend did. The point is that this policy was not allowed to be given to me because of this, and my insurance company should have never written this type of policy for me. Thanks anyway for your reply Lori.

I've the same question as tcope, haven't you checked the policy papers before signing?

Lori, I'm just curious, as the insurance company has sold her the policy knowing the fact that they can't sell a non-owners insurance to a person, who has more than occasional access to the vehicles, hasn't they operated under bad faith?

Hey guys!
I just started another post in continuation to this one. Your not going to belive what the company did now! The post is entitled, "This name non-owner situation is driving me crazy!" Also, keep in mind that this is not some "rinky-dink" company. It is well known, especially here in Ohio.

OP, have you asked your agent why the insurance company issued the policy knowing that they would not honor it?

There is not enough information known to give good info... I see two choices for the insurance company... rescind your policy (cancel it as never in force), in which case they would need to refund all premium. Or cancel the policy for material misrepresentation... which, per your posts, did not happen.

I really think you need to sit down with your agent (not just anyone in the office) and have a discussion to found out some facts.

See that's my point...she would've had coverage under her 'drivers policy' just not on the three cars in the household...if she used my car, then she would've been covered...therefore she has been protected (as non-owner driver) for the term she has paid...right?

According to the Division of Insurance "in theory" you would be right Lori. As explained to me by the Division though, the policy was actually not allowed to be given to me in the first place because I reside in a home where a household member owns vehicles. Also, the sr22 attached to that policy is not legitimate because the policy is not considered legitimate. So, therefore, I cannot drive until I hear back from my boyfriend's agent to let me know that I am insured by my boyfriend's insurance policy w/an sr22 filing. Instead of selling me a policy, my agent should've advised me to contact my boyfriend's agent in the first place. I initially contacted my agent to see what I needed to do in order to get an sr22 bond. (I thought there was a difference between a filing and a bond) It appears that my agent was only interested in selling a policy instead of what was the right thing to do.

Please let us know the outcome of this...you have contacted the actual insurance company? policy services maybe? If not they certainly need to know, I would ask to speak to a MANAGER, not a teamleader or supervisor but someone who manages either issueing of new policys and/or the agent's district sales manager...am I to assume this is Progressive? (from your post in the other thread).....If so I don't think they will take this lightly at all...once they are aware of what exactly happened.

No, the insurance company is not Progressive. Good guess though!!! I will definately keep you all up to speed as this situation progresses.
