A lady turn left in front of me total out my car ,my insurance was cancelled 2 month before it happen she is at fault but her insurance company won't pay for first 15000 of damages .under no pay no play law In state Of La my car only worth $8000 can I take her to court for my money for my car since insurance company won't pay ?Can I win ?Report states she fail to yield _________________ Register Now to have your Insurance queries solved. |

You'll probably need to bear a deductible before you may file a lawsuit against the other party.
Some of us have earlier shown us through examples wherein this "No pay no play" law stands beneficial for insurance companies. To know more, go through the following thread -

If you have no insurance, you have no deductible. You own 100% of the loss. If the other party was at fault, her insurance will pay your property damage claim -- there is no deductible in that case.
You file a claim for the damage to your vehicle with the at fault party's insurance company. Because you had no insurance at the time of the collision, you cannot collect anything for "non-economic" damages ("pain & suffering"), but you can collect for things such as medical expenses and lost time from work. _________________ CA-licensed P&C Broker-Agent and Life Agent.
