Why would the minor drive the car, anyway?

LOL. Good one T scope. I wonder if the person is thinking the check for injuries would be issued in their name. If this os the case its not happening and rightfully so. Any money awarded to the minor child will go into a bank account until the child turns 18. I think this is a grand idea. If anyone can remember back to that ripe old age they will probalt remember how hard it was to get started. The money was for the childs pain and suffering. They should eb able to use it for their needs. College is not cheap and neither is a decent vehicle to get back and fourth to work.

That is a good point fireyone and now that you mention it, I think you are correct.

Each state has a different threshold but if the amount is less then that amount, then the payment can be made to the parents on behalf of the child. If the amount is more then a certain amount, then it needs to have the approval of the court. But even then, the amount is still issued to the parents as far as I know. If it's a large amount, I'd think most parents would put it into an account for the child until they turn 18 but I don't think there is a requirement for this. Of course, some minor children have sued their parents for spending money that should have gone to the child. If the amount is great enough to require approval by a court, the court _might_ put stipulations on what is to be done with the money (I'm not sure about this).

Tscope, I am going through this here in PA with my daughter. In this state all money collected must go into a bank of the parents choice until the child turns 18. At least this is what my atty advised me. I am fine with the idea and applaud any state that has this law. It protects a "bad parent" from using the childs money and keeps the teenager who has yet to learn the value of a dollar from spending it friviously.

Zandile:

In Kansas, minors are allowed to drive as "permitted"; the claim would be on the parents' policy, but the minor listed as the vehicle operator; therefore, surchargeable against the policy.

I guess I did not stop and think of it matbe being this way. I wonder if the poster was talking about whether the accident would go against the minors record or the parents. I just have a hard time believing a minor of fifteen years old would be legally able to drive. Is there any states woth an age limit this low?

Kansas youth can get a "restricted license" at age 14 (still on the books for farming reasons). Strange, but true.
