i got a new car in july of '08. brand new off the lot and totaled it in jan. due to deer and road conditions.
i was an excluded driver in '02 because i had a dui.now 7 years later i get a new car and their holding that policy against me. when buying a new car shouldn't there be a new insurance policy in every new car

Holding it against you... how? Higher rates or not willing to issue the policy? This would be based on the *DUI*, not the insurance policy itself.

What does getting in a wreck have to do with the insurance company holding something against you and the new policy?

Yup, this has baffled me too....I'm not too confident about this query.

OP, you had a car which you have totaled last Jan. Hope you had coverage on it that time. Now, is the company denying the claim stating that you had DUI against you and therefore is uninsurable?

Can someone clear it for me please? :(

Usually insurance policies (at least here) are renewed every six months. Why wouldn't this issue have come up at that time or at the time of adding the new car. Were you still an excluded driver on the new policy? I can not see how if you were issued a policy. Seven years seems like an awful long time to hold a DUI against you. I would imagine by that time even rates should have dropped back down. What does you insurance company have to say? Did you ask your agent to explain?

indeed, 7 years is an extremely long time. i'm kind of confused here. did you call up your insurance company to ask for details? i would advise you to call them up, and ask about the it. we can't provide much help based on the information you have given us so far.
