If my car was hit

If my car was hit by someone exiting a Burger King drive -thru .as i was leaving a parking lot and i was hit on my passenger side door. (my door won't open) It was at night and i didn' didn't think it was as bad as it is !!!. WE were both really shook up ! So we did not exchange any info. But i did get his license plate number and make and model of his suv. Can i still hold him responsible to fix my car.

You certainly don't give enough details for anyone to make a liability determination. Also, parking lot accidents are tough to determine.

Exchanging information is "Driving 101". I can't imagine anyone shook up enough not to thing about exchanging drivers license information.

On what ground? Its hard to determine who's at fault from what you have said. As Tcope has said determining fault in a parking lot accident is particularly difficult. Moreover, both the cars were moving at the time of the incident.

I'd rather suggest that you speak to your insurance carrier first.

Ain't that the truth...I too find it hard to understand how you could be hit hard enough that the door of your car won't open yet, you didn't even get the guys name? Contact your carrier file a claim with them, they in turn, will try and hunt down the other guy...burger king probably has some outside cameras that might've caught the accident...remember however, you could be at fault as well (now way to tell from your facts of the accident as stated thus far)...at any rate you need to let your carrier know, because he could be thinking the same thing you are...(hey, wait a minute), i need to "hold her responsible to fix my car." and file with his carrier, suppling them with your plate number...

lesson learned huh? ALWAYS get all info at the scene...

Things could be a bit tough for you since you didn't get hold of the other party's information. Exchanging license information is one of the foremost things that you'd need to do under such circumstances.

Burger King (as Lori pointed out) could come to your help but it could then be a long drawn thing for you. Please do keep in touch! Roddick

I too didn't understand why the door wouldn't open even when it was hit so hard. But now, please tell me whether the carriers really take the trouble to hunt down the other guy? If you've come across such instances, please care to share with me.
