No-Fault Accident

Hello everyone,

I was parked along side a street and someone was trying to parallel park and he hit the front of my car and caused about 2500 dollars in damages. Since I am not at fault, will my insurance rates increase? I am a 17 year old driver with no tickets or accidents on my record. My car was in park so it definitely wasn't my fault at all. The party at fault will be going to their insurance company to file a claim and they require me to give them my insurance information. Do you think anything will be reported to my insurance company? I have 21st Century and he has State Farm.

i wanted to say "Hello". You picked a well, inform to post at. :D ALOT of knowledgeable people here.........I've learned alot, myself. Well.........first of all why would the OTHER person file a claim..do you mean aqainst YOU? If the accident happened the way it did, and you were parked, I don't see how YOUR rates would go up. Glad to hear you don't have any tickets, etc. Good for you!! To give 'details' on how to help, I'm not an 'expert'...OF of those experts will be along shortly. Just wanted to put my '2 cents in', I suppose. Again...Welcome to the forum.

thanks so much for your advice. I really meant to ask will state farm contact my insurance company, 21st Century, informing them of the accident even though I am not at fault. Apparently according to other websites insurance premiums can still increase even though I am not at fault only because I might be tagged as an at risk driver.

Well.I don't know how you were a 'risk' driver, in THIS case. Your car was parked...right? If the OTHER driver reports the accident, I would ALMOST bet HIS insurance rates would go up.since he is the one who hit YOU. Did you have any witnesses that saw the accident? Were you in or out of your car? I'm just curious.

I'm just wondering if my rates would go up only because I've heard that whenever anyone is in an accident, both parties insurance rates will go up regardless of who was at fault. I am not sure if the is true though. Yes someone did witness this accident.

Can you get some kind of statement from the person who witnessed the accident, if you din't already? I don't know if the insurance rates will go up on BOTH of you. That's where one of our 'experts' will come in. I'm sure someone will be around soon.

Good, and you left out that you already pay huge premiums...all young men (girls too) your age have enormous rates...

No, no they don't nor would i give them that information, unless they can prove to me it's a law (it's not)...

If you haven't given them your carriers information then don't, just when they ask say, 'i'd rather not give that information, nor do I find it relevant, my car was legally parked''' same as you'd tell someone if they ask for SS #...

You wouldn't be tagged as high risk, but some companys have lower rates, or you can 'earn' a discount for no claims, (whether your fault or payment or not) that is why I wouldn't give up the information..no way no how...ESPECIALLY given the rate class you are already in...now that being said if you see this claim going back...you need to let your carrier know...what i mean by 'going bad' is if st. farm isn't moving to get this handled quickly...what have they said so far, if anything? is the guy that hit you going to turn in the claim ? has he? how long ago was it? You do have all his information right?

This is not true and bad information you cannot be rated up for an non-chargeable (not at fault) accident...however as i said some companys offer 'discounts' (losing a discount is completely different than getting rated up, or a rate increase for an accident.)

Is this witness 'independent' meaning not in either vehicle or not known to either driver?

Thanks, LORI. I wasn't sure HOW to answer some of the questions in detail. I could have sworn that, at the beginning of the post, that you said you were parked, DIESEL. LORI gives WONDERFUL 'direction' on insurance issues. Listen to her!! :D

Well he seems like he is cooperating. This happened today. I had an estimate that came out to 2400 dollars. So as far as giving him my insurance information, if you go on the state farm website and try to report a claim it says that it they need the victims insurance information. I was in the car and I tried to reverse but he hit me before I has the chance to. I do have all his information and yes the witness is a third party.
Also, do you think that I should file a police report if he is cooperating with me like this? I think that if I do file the report, the accident will show up on my driving record and I'd rather that not happen...

From experience, DEISEL, I think you should have called the police BEFORE anyone left the scene. But, since that wasn't done, that's neither 'here or there' now. If I were you, yes,...I WOULD call the police and let them know about the accident. Just in case the other person DID call and said you fled the scene, or something like that..ya know? Just to 'cover yourselve'. Do you have a number you can call..your Insurance agent, I mean? Were you moving, AT ALL, when he hit you?

I guess that a $2400 worth of damage requires reporting it to the police, especially, since, the accident happened in a public parking. However, since that matters are going smoothly you may avoid informing the police. Were you injured in the accident? It may add a new angle to the situation.

Have you been contacted by the other driver's insurer yet?
