A couple of days ago I was rearended on the interstate. I live in North Carolina and the other driver was at fault. My car is '98 Ford Mustang Gt It will undoubtly be a totaled. My delimma is that I owe more than its worth, I probably owe $1500 more than the ACV. I don't have GAP insurance, but I was wandering if I have any hope of getting the insurance company to settle for the payoff amount and not the ACV.

As far as injury claims I told the adjuster I was fine which was probably a bad idea as i now am expereincing neck injuries. My girlfriend who was in the passenger seat did go to the ER and get x-rays due to chest pains and a minor wrist injury. She also has had neck pains which are causing headaches and nausea(migrain). How much should we ask for when settleing.

On behalf of my girlfriend is it possible to get reimbursemnet for personal items. She was carrying her purse ($300) and her wallet ($250). They were both ruined when the airbag crushed her cup of cheerwine.

I have only talked to the adjuster once and just want to be ready for whats still to come. Of course I don't expect exact figures, but ballpark figures would be greatly appreciated. Thanks in advance for any advice.

More then likely the carrier will only consider the ACV of your vehicle, not the payoff amount. That is all that they owe.

It's very common for the pain of a soft tissue injury to start a day or two after the accident. My recommendation is to let the adjuster know of your pain and seek any reasonable medical treatment. There is no way for anyone to tell you what you should ask for. This requires many details including a review of your medical records and to know the entire cost of your medical treatment.

Yes, your GF's property damage should be paid for. Bring this loss to the adjusters attention.

Hi jrandllduke, tcope is right, unfortunately the insurer will pay only the ACV of the car and not the payoff amount. However, you can negotiate the with them to some extent for the amount payable towards the totaled vehicle.

Well, I don't think that without the exact description of the damages the adjuster will be able to quote any tentative amount even. You may consider elucidating the nature of the damages you have sustained for the quote.

Well, apparently you should receive compensation for the prescription drugs, visits to the doctor, expenses for the tests, wage loss, therapeutic treatments (if required) and also for the pains and sufferings.

The claim package should also include the costs of all the future treatment that the victim may require.

Preserve all the prescriptions and bills for future references. These all will come handy while negotiating with the adjuster.
