my lawyers say ican sue but thereb lawyer says because i signed a release form not to sue the insurance company

Can you sue an insurance company? I can count the number of states that allow this on one hand (and I'd probably have several fingers to spare).

Your attorney tells you that you can sue but your asking people here if you can sue? Unless there is an attorney here more familiar with your situation then your attorney, I'd say you might want to go with what he is telling you.

If you sign a release and the insurance company is listed on that release, you cannot sue them. That release states that your accepting $xxx and in return you cannot go after them any longer.

Doubt you would be actually sueing the company...have you settled the claim already? Is this an auto injury claim? If you settled it and signed a release why are you now coming back with an attorney wanting more? still have all that money? we need more information, but I also wonder if you do indeed have an attorney why do you not believe him/her, and why would you be talking to the attorney from the carrier?

I agree with the other two posters that you might not have a chance to sue the insurance company.

The insurance company's lawyer is right in saying that after signing the release form, you can't actually sue the other party or the insurance company.

I dunno how your lawyer is gonna file the case :confused: However, more information is required, like- your state of residence, type of claim and so forth.
