My son was ticketed in a rear end collision accident. He is 21 college student and owner of the vehicle, however, I carry the auto policy with him as a insured driver. Can I be sued for liability damages? The person that was in the car that was hit is suing for physical pain and suffering.

Since he is an insured driver in your policy the claim is required to be filed against you as well. Does your son has a separate policy? The Florida laws allow the claimant to sue both the operator and the owner of the vehicle. Have you discussed this issue with you adjuster yet? You may need to know whether or not you'll receive legal representation from the insurer in case you get sued.

And, therefore, the lawsuit will be filed against the driver/owner of the car, i.e. the son. However, the claim will be paid out of the mother's policy since the son is enlisted in it.

No not if you are not an owner, just being on the same insurance policy does not make you in anyway liable..if your names on the title of the car...then yes maybe...

Are you sure they are sueing? likely just have an attorney would be my bet...your boys insurance in handling the injury claim right? What are his Bodily Injury limits and what is their injury?

No Barbara that is incorrect...if the OP is an owner maybe but not just because she is a listed driver on the policy.

not to worry thats what insurance is for, accidents hapen thats why we use insurance, your insurance may go up, depends if you are protected, i wouldnt lose any sleep over it.........
