i dont want my car to be a total lost... i have invest a lot

my car us stolen and recovere,,they strip the inside,,,know the insurance say the car ud cust more that 80% and they have to total my car,,,please let me know what can i do to not total lost my car

Okay, if the repair cost of the car is going to exceed 80% of its value the insurance company would definitely declare it as total loss. And, they might not allow you to retain the vehicle.

Now, if they allow you to retain it, will you be better of? I figure you have already invested a lot on it, would you like to make additional investment on it? To make the car road worthy you have to repair it and get the OK certificate from the highway department. And, that too would cost you a lot. Consider all the aspects before taking any decision.

I agree with jeremy on this issue. that surely it will be considered as total loss if the percentage of loss is more than 80 % but i am not sure why do you want to stick to the same stance of not looking for the new car instead of going for the new car.

yes, definitely, i agree with jeremy as well. a vehicle is declared as total loss with the repair cost exceeds 80% of the ACV (Actual Cash Value) of the car. i understand that you're probably feeling attached to the vehicle after spending so much on it, but considering that the vehicle should be rather badly damaged, it may be more worthwhile to get a new car.

if you want to salvage your vehicle, it may end up less worthwhile, because repair costs is not going to be easy on your pockets. like what jeremy mentioned, the insurance company may not even allow you to retain your car.

Here's the deal: they don't want your car. The state law requires the vehicle be declared a 'total loss' when repair costs reach or exceed the value or a set percentage of the market value. That's it -- game over. They do NOT owe you replacement value. They should pay you ACV (actual cash value) which is another word for market value or what cars like yours with similar options, mileage and condition are selling for in your area. They are probably giving you the choice of keeping the car as salvage and paying you the remainder after deducting for salvage cost. You keep the car but will have a horrific time getting it repaired and back on the road with a clean license. There is really nothing to fight here unless you can prove that your car is worth more than their accessment. Check classifieds, car lots and the internet to make sure. If you find out that the offer is good then I suggest you let it go and just buy another.
PS - if you owe more than it's worth they will NOT pay it off. Sorry.

Well, I just wrecked my car last week and wanted my car repaired as well. My insurance company declared it a total loss and refused to pay for the repair even though I offered to pay for the repairing costs exceeding the ACV. They simply want to have it totaled since they can get at least $2,000 salvage value from junk yard. Does anyone know if I have a fighting chance in court to make the insurance company pay for that much repair cost?

You could hire an independent adjuster to look at it, but I have never seen damage that would turn a decision, very often. You can't take them to court, but even if you could, the cost would not likely be cost effective. Unless a carrier has incorrectly written the estimate (too much ot too little) your chances are slim.

Read your policy. Chances are is states that they can either pay for the repairs or pay the value of the vehicle. This is what you agreed to when you obtained the policy. So the answer is no. If you had $1 in damages the insurance company could pay for the value if they wanted.

my insurance wants to total my vehicle after my car accident, they had two adjusters look at my vehicle. i had the insurance company fax me both estimates, i then had my body shop run their own estimate. after my body shop and i reviewed both estimates, we noticed that the adjusters had put parts that were no need of replacement into the claim and also they over priced alot of the parts and labor. my body shop sent the insurance their estimate which is $2,600 less still doesn't want to pay for repairs even though it keeps me well under the 70% of my car value.
