Regarding a totaled car

by Goose811 » Thu Jan 08, 2009 02:04 pm

I live in Massachusetts, my car was totaled about 2 years ago. I got a check for it and bought the car back, because it drives fine. I still drove the car and kept in insured. Last night I got hit from behind and then I hit a parked car. Will I get paid through that persons insurance? Or will I get nothing because my car was previously totaled? Pleas leave email address for me to reply thanks

You will be paid, as the vehicle you were driving still has value. If the other carrier finds out that your vehicle was a prior total loss, they will probably offer a reduced value on the vehicle for this reason. Typically it's 25% less then the value of a non-total loss vehicle.

Goose, you can always come back and thank the members in this forums. Also, never hesitate to ask the community if you have any insurance question.

However, if the other driver is at fault, his/her insurer may cover the claim. I'd say that turn the claim to the insurer and wait for their reply.

You should get paid through that persons insurance because it wasn't your fault, if you can prove that you shouyld be fine, also hitting that parked car wasn't your fault either, collateral damage shouyld also be paid out by the person who hit you.

adding to Tcopes post...there may also be a reduction if the damage was not repaired, depends on if it detacts from the value at all, given it's salvage title status...but yes, you are still entitled to 'something' for your vehicle even if it is basic transportation...is your vehicle still driveable from this accident(s) too?

I would imagine a case like this would be a hard one for adjusters. The 25% less value would not be so bad but to sort out old damage from new would maybe add a little headache and maybe cause a little contraversy between the adjuster and the vehicle owner. Ever had a case like this?

too many over the years...for the most part people that are driving vehicles with a salvage title understand that they are worth less, and usually are a little easier to deal with...and most do 'some' repair on them....any vehicle that is moving down the road is worth 500-1000 as basic transportation....then the problems really come into play when it totals twice and keeps on driving! :) the next claim on that vehicle is a total yet again, and you can almost be assured it will be basic transportation.
