Will the other persons insurance pay for my truck?

I got into an accident last month and it wasnt my fault. I got hit in the rear end on the driver side. The adjuster with the other persons insurance company came out the other day and said that my truck is a total loss now. Its a 2001 C1500 chevy silverado. I was just wondering will that insurace company pay for my truck since it was his fault. And im still paying for this truck also.Please someone help so ill know what to be looking for when i get all the info when they call.

as far as i have understood the question rightly, if the hit is from rear end

then also you need to prove that it wasn't your fault.( it could be one of the

possibility that you were driving too slow, or you have used emergency

breaks) So you need to prove that before the adjuster & then you will

have some stance about it. Don't misunderstood me, it could be one of

the possibility & even the adjuster may ask you these types of questions.

I'm not clear about this statement....do you want them to repay the loan on your behalf?? If your car has got 'totaled' the responsible driver's insurer would only pay for the actual cash value of the car, which might or might not meet the entire loan amount. And, you'll be responsible for the rest. Now if you have Gap insurance on the truck. It'd then bridge the gap between the loan amount and claim check.

It might not happen that way always. If you have taken the 'gap' policy along with the collision and comprehensive coverage from your insurer, they may restrict its payout only to the collision & comprehensive claims, that is, if its a third party claim you may not receives the benefits from the gap coverage since the claim wasn't filed with the comp&coll coverage.

However, not all policies are the same. Hence, you may need to go through the policy document to find out more.

Your bewst bet for a direct answer would be to call your auto insurance agency or your company directly. They will be able to pull your policy and tell you exactly how your policy works. Its better than thinking of all the what-ifs. A quick call could ease your mind.

Are you paying out of your pocket or do you have auto insurance to pay?

And I am wondering, does your state have any statute of limitations on the time by when you should make your auto insurance claim? If not, then maybe you can still file your claim. Talk to your insurance agent (if you have a policy) and let him guide you best with the claim.

Maybe, maybe not. Your auto liability, tuohgh, will NOT pay for damage you do to your house. See, that liability coverage really is damage to property of OTHERS . It doesn't cover damage to property that is YOURS. So. The auto policy won't pay, for sure. And some homeowners policies ALSO exclude damage done to the building, by a car owned by or operated by a household member or the insured.You'll have to ask your agent, or read your policy.

I just got into an accident that wasnt my fault. I was gong northbound and she going southbound. I was coming through a redlight and the light was green but she was trying to turn left and t-boned me on the driverside. I have liability insurance and im still making payments on my truck. Its also my only way to work. Whats going to happen?

If it was not your fault, file a claim against the other driver's policy. Her insurer will investigate the claim , and pay you if she was at fault.

In this case, always there is a problem that the one who is not at all faulty has to prove that he has not done the following case. However in such situations, even if the person is innocent then also he has to prove for it. Main thing is that insurance companies believe on self analysis or the report of police. Whatever may be the consequences, but if it is proved that you are innocent then the other insurance company will pay for your truck.
