Auto policy in my name without my consent?

I had auto insurance through my fathers insurance policy. I had my own invoice which I paid every month online. A few days ago I wanted to make my payment but I could not access my account so I called customer support and they informed me that I had a new individual police in effect from june 2nd,2009. The agent could sense my frustrations and told me that she was going to e-mail my agent. The next day the agent called me to give me news that that they opened a brand new policy in my name without my consent. He said that he did not communicate with me and he was sorry. I feel being voilated my rights as a consumer. Is this legal???

Did you ask anything to your father regarding the new arrangement?

He said that he did not communicate with me and he was sorry.


Did he come up with any excuses?

No. I have not heard from my father. We have not been in talking terms lately. The agent said that he went by what my father told him. I made him clear that my father had the right to cancel my name but the agent was supposed to inform me about it and ask me if I wished to open a new policy. I told him that he had no right to open a policy without any communication or my consent, If I had known I would have shopped for a company and policy to best serve my needs.

What exactly are the changes made in the policy?

Has your father excluded you from his policy? Does the car that you drive own by your father?

(Hello, everyone...been away for a while). Gosh....isn't that a violation of your rights, OP? Why din't the Insurance Co contact you? I would think if another policy was 'open' in YOUR name, you would have to sign something..I'm ASSUMING anyway.

I'm sure your father has the right to detach you from his policy.

But is it true that he'd instructed the agent to open a new one for you?

By no means, should this agent listen to your father at opening a brand new policy for you. I understand that the new policy benefits may not serve the best of your interests.

I understand that the agent was sorry about not communicating the matter to you. But did he send any paper works?

Did you ask him regarding the paper works related to the new policy?

I own my car.

I just received my paperwork yesterday. It consists of insurance card and shows the start as June 2,09.

Should I just get insurance from another company and deal with mess legally? I have a company car so I just use my personal vehicle on weekends.

When I spoke to the agent yesterday he mentioned that my rate had gone up by about 40% because I lost some discounts..like multiple vehicles and stuff..
I told him I did not care about price but it has to be my decision to to get their services or not. I even told the agent that they had no right to run credit on my name and stuff without me approving. He just said he was sorry and he thought my father had spoken to me and stuff. He said that he wished he would have done a better job and communicated with me.

Its really an interesting situation. Since the policy is already in effect someone might have paid the premium on it. Who has paid the premium, your father?

Also, I guess that you don't remember signing any policy document, right?

Have you considered the option of shopping around since the rate would go up by 40% with the new policy?

I guess that while communicating with the agent he has told you about running the credit check. Did he?

He said that he wished he would have done a better job and communicated with me.



It doesn't really matter at this point of time. Some things are truly surprising with your agent.

I guess it wouldn't be wise for you to quit the current policy services till you've registered with another carrier.

It would have been better if you could read through the clauses of your old policy once to check whether there is any mention of selling it without notifying it to the policy holder.

Do you have any papers concerning the earlier policy with you now?

He just said he was sorry and he thought my father had spoken to me and stuff.



Can you ask him to get you an access to the old paper works (or may be copies of the papers) now?

Who legally owns the vehicle? If you were originally insured on your father's policy, then he was the owner at that time. You wouldn't have your own policy for a vehicle you did not own. Something isn't adding up. Unless your father has transferred ownership of the vehicle to you, then the new policy must still be in his name with you listed as the primary driver.
