Who is legally responsible to bury a spouse who does not receive the life insurance proceeds or assests from a will.

Well, 'wow' is what comes to mind first...

I don't think anyone is 'legally' responsible to bury anyone...morally, yep...legally...i doubt anyone is...the person responsible will be the one that signs the bill at the funeral home and the cemetary...

Please explain this situation a little better including your state...has the spouse already passed or are we 'wondering'? If already gone, then who made the arrangements and signed the forms saying they would be responsible?

I'd say the estate is legally responsible. After expenses are paid for, the estate addresses the remaining assets.

but they can't hold the poor guy to bury him till all of that is figured out right? and what if there is no money?

I think who ever foots the bill for the burial (probably the state if no one makes arrangements) is paid back by the estate.

Not a good way to leave...? I'm wanting to be pushed into a hole and if I had my way, it would be more of a ditch so no one would have to work to dig it. As it is, I've asked for a cardboard coffen and that all my relatives and friends have a party instead!

Did I not mention that I will be _dead_?

Might just be me but I never understood the attraction of seeing a dead body.

So, no one is actually responsible for burying a dead.....I think if the other spouse is still alive he/she is responsible to take care of the last rights of the dead spouse. However, if they were divorced then its altogether a different issue.

Why was the spouse hadn't received anything from the will?

Did the deceased have a will in the first place?

If there is a will, who is the executor? Executor will distribute the estate as per the will

Not _who_ will pay for it... who is _responsible_. If no one _wants_ to pay for it, then the estate would be _responsible_.

Well there went my plan to plop a 'gracho' set of glasses, nose and mustash on ya'... :wink: I don't know it's a creepy tradition when you really think about it, and analyis it ...but it's what we know I guess.

Yes, at least that's what I know. If a body goes unclaimed , then his/her employees or anyone who comes into possession of the unclaimed body needs to notify about the burial at public expense to the state.
