Personal liability insurance for work-related mess

by malantietam » Mon Mar 29, 2010 03:44 pm

My husband works as a manager for a company, and does not own it. There is a chance that he might get sued (wrongly, of course) for slander. The company that he works for might not be named in the possible suit. I cannot find a personal liability insurance policy based in the US that would cover this. He has State Farm, but they won't cover something like this. Can you help?

malantietam, I'm sorry but NO carrier is going to write a policy that will 'back up' and pick up this claim..none, never ever....

I don't understand how he can be sued and the business he works for not be named in the suit, (they would have the deeper pockets I would think).

"Slander" is EXTREMELY hard to prove. You not only have to prove it occured, but you further have to prove you were economically injured, by the said slanderous comments.

If this happened as a result of your husbands work then he should be considered an insured under the company policy. You should also have some type of property policy and if so, these provide liability coverage for him personally.

As mentioned, coverage is no going to be back dated.

There IS coverage available for this.

Commercial General Liability, or CGL policies provide coverage for "personal injury" committed by an insured. Chances are that your husband, as an employee of the company, will be considered an insured under the employer's CGL coverage, although that is not a given.

Personal lines homeowners insurance policies can also be endorsed against personal injury losses, but it has to be specifically endorsed onto the policy and not all carriers offer the endorsement.

Personal Injury is slander, libel, false arrest and imprisonment, etc. Has nothing to with bodily injury...

But teacher....no carrier is going to write a policy NOW and back up and cover this claim...

Lori, you're right, there's no way coverage will be backdated for this. Period. The coverage had to already be in place.

commercial property insurance also plays a great role in business insurance policy.. Without this important protection many companies would have to close their doors, lay off employees and file bankruptcy.

Doesn't really shed any light on the OP's question, does it? And isn't necessarily true either.

Were you and your husband able to to work with his employer to get this issue resolved? I know that did not find insurance (I would be completely shocked if you did), but it would be nice for people reading this in the future to know how you resolved the situation.
