big problem!

i hit a parked car coz i was setting up my gps and suddenly i hit the car.. it was an accident

the damage i did was over $10,000... and my insurance is only paying for $10,000.. i hit a parked car and there was no injury.. and now the owner of the car i hit is mad at me for not having "enough insurance" and he expects me to pay the damages i did or he'll sue me.. well im broke financially and i dont think i can pay him..

right now he said he's repairing the car and renting a car at the same time and i better pay everything off after its done......

im really screwed at this situation...

is there anything i can do? i cant pay the damages i did..

My friend, do you belong to an add-on or no-fault or tort state? You may be sued by him if you belong to a tort state. Incase you belong to an Add-On state you may rest assured that the drivers would be compensated for this loss through their insurers just as in a No-fault state. He might sue you since there are no restrictions on lawsuits.

But if you belong to an add-on state then this gentleman is surely pulling you for an excess. Whatever way the blame comes I wish you to defend your stance since it was not a deliberate fault on your part! Also show him the reason that if your insurer feeds for his loss you won't be a patch on it. If the problem still persists, you need to consult your agent.

thats really a big problem in front of you....
try to talk and have a nice informal chat with the other driver...
i hope he will understand your situation and will be little lenient with you..

I would want my damages paid if you hit my car, wouldn't you? Why do you only have $10,000 limit, that is not a whole lot. I don't know what to tell you, but you may want to increase your limits after this incident/accident. Stay off the cell phones and don't play with the gps system while driving. A little common sense would have saved you alot of money, you are probably going to have to pay the guy, he will probably take you to civil court and sue you for the balance, he will have to prove that it cost that much to pay for the damage of course.

I agree with you on this too dreamer, I would think if it was me and your insurance was not enough to cover it, you better come up with the money some how, I know that is not what you want to hear but my car was parked, now I am without because of your actions.

Hang in there though, someone else may come along and give a different answer, I am just thinking from the other guys point of view.

Accident or not, it was your fault for messing with the GPS system while driving, and I'm certain your insurance company would agree. If talking on a cell phone can get you pulled over, I'm sure that setting up the GPS, which requires visual attention which should be on the road, will be treated the same way.

One important thing that is taught in driving school: Keep your eyes on the road.


On paying him though, you might want to try and negotiate an agreement with him to pay it off over a period of time. At least that way, he can't say that you're not taking responsibility.

You may be able to work something out like Quenlin is saying, the body shop where he is getting it fixed my work with you on payments also. You have got to do something, this guy is out his ride over your not paying attention to the road. I think you honestly do want to work this out, try explaining it to him and see if he will listen, maybe by now he has had sometime to cool down, Will his insurance pay and then go after you for the balance? Have you approach them on this?
