Lapse in Insurance Coverage

My wife was in a car accident on the 25, and I filed the insurance claim on the 26. I was then informed by Mercury Insurance. That a lapse took effect on the on the 23 and I had no idea.

I had never received a letter from the insurance company about the lapse in coverage before the accident occurred. In fact I got a warning letter 2 days after on the 27th dated the 25th saying that the policy would be cancel on the 23rd if payment was not made.

The envelope for the letter was postdated on the 26.

If I did not receive the warning letter until after the lapse occurred will still have to honor my claim?

If the policy got canceled, then I'm afraid you are not entitled to file a claim.

I don't think this was a "warning" letter. If you reread the letter, it was probably your CANCELLATION NOTICE advising you that your coverage ceased on the 23rd. Your LAPSE NOTICE would have come about two weeks earlier.

You can ask the insurance company for a Proof of Mailing and most likely it will be as Max pointed out.. confirmation that several notices were sent well before the policy cancelled. Not knowing your policy cancelled really does not fly. Did you not make a payment? On top of that I'm betting the carrier did mail out several notices. People usually "don't know" that they never made a payment until after an accident happens. It's odd how that works.
