Hi.
My father in law died recently. Both he and my mother in law were in a nursing home paid primarly by Medicaid. She still is in the nursing home. He died with one bank account in the amount of about $ 1,800. Florida has a proceeding called "Disposition of Personal Property without Admin." ( in lieu of a formal probate proceeding ).

Query : If she inherits this sum from my father in law, will that cause problems
with Medicaid ?

Many thanks.
Marc

$1800? Only to the extent it exceeds her monthly test of assets to qualify for Medicaid. It won't cover 1/2 of 1 month of her nursing home expenses, so the answer is probably no, it will not cause problems.

The state's interest is in recovering whatever it can to offset the amount of federal money that was consumed to pay for their nursing home expenses after their deaths. The home is the primary asset subject to recovery under the federal Medicaid rules.

It's very expensive to create and maintain the trust that your dear one keeps on us. Yes!! She can take the inheritance benefit, only if your father-in-law has subjected his wife names of the beneficiaries in the Medicaid plan. Medicaid will have a lien against any assets of the deceased person for whom Medicaid as paid expenses. You can still contact to an expert medicaid lawyer NJ for more details.
