Breach Of Contract

Dear Sir,

We put in a claim for subsidence back in Aug 2009 and to date nothing has been done except the conservatory which is being under pinned as we speak. The house has moved a total of 30mm and keeps moving up and down on a seasonal basis.

We involved the Ombudsman last June and are still waiting on a resolution from them also, although we are very disappointed to find out they will only make them pay £1000 if they feel they are in breach. 5yrs of living in a house that is falling down around our ears, has cracks in the walls, coving has fallen down due and we are unable to decorate of change anything as advised by the insurance company.

We are at the end of our tether and all we get when calling for an update is 'we are just waiting for...'

What is your view on our situation....should we/can we sue this insurance company for breach of contract? Every surveyor to attend our house has been horrified at the length of time this has taken and is still taking.

Based on your reference to "£1000" it appears that you are in the UK. We don't have the answer you need. Speak to a UK-based solicitor about your matter.
