I had a pre~existing herniated disc which I was released by my doc feb 4, 2013. feb 21 a lady hits me fro the rear and driverside while stopped at a stopped school bus. injuries was a throraic strain and it aggrevated the herniated disc. insurance is offeribg 400 plus medical bills of 5100. would u consider this fair.

It completely depends on what medical assistance you require now and how much would it cost. If 400 plus medical bills of 5100 is just enough for the expenses, then you should not complain.

It completely depends on how much your medical treatment will end up costing you. If that's enough to cover your medical bills once your treated for throraic strain and to get the herniated disc under control, then yes it's very fair. If not, then you need to notify the claims adjuster and request that they cover the additional expenses. You'll need proof that it cost more, such as estimates & bills from your medical provider. Plus, if you have health insurance then the auto insurance will coordinate and only cover what your health insurance does not, so keep that in mind. If you haven't been treated yet, you need to do so as soon as possible and ask for the estimated cost of treatment beforehand. If it ends up being more, try to negotiate with your medical provider to lower the price and call the claims adjuster with the estimate to ask for a higher payout.

Also keep in mind that the payment isn't to cover continued treatment of your herniated disk since it was pre-existing, but only to get it under control & back to where you were before the accident. Good luck!

Whether or not the compensation out of your insurance policy will cover the entire cost of treatment will depend on the total hospital bill and if it does, then its good luck for you.

I'd consider that an initial offer. Initial as in, you can demand more and you both will negotiate a settlement.

Also, by it's vary nature an initial offer will be low.
