What to do if the other one was not insured!

I have just met with an accident. The other party was uninsured. Whats steps do I take now! Gwen LOLLY

Hey! now the first thing that you should do is to report to your state dept of revenue. This is a body that enforces any laws related to financial responsibility. They would undergo a thorough check. In case of any injury caused to you, its upto you whether you'd like to report to your UM company. Fatman.

Well, its all about bodily injuries. IT covers any fatal consequence against hit-n-runners! Also it takes care of injuries when you get hit by someone uninsured. George.

Again, there are two flavors of Uninsured/Underinsured Motorist coverage. There is UM Bodily Injury (applies to insures only) and UM Property Damage which applies only to property damage. UMPD is available in only a handfull of states.

As fatman suggests, you should report the accident to the state. They can hold the driver responsible for the PD until he/she can prove that the loss was satisfied. Many states will suspend the person's drivers license until this is done.

You should also inquire from your insurance company if you have any coverage under your policy that would address your loss.

I trust you filed a police report.

Yes you need a police report, and contact your company to see if your company will cover any of the damages. If so then your company will most likely go after the uninsured party for the losses......

Unfortunately, yours is not an uncommon occurrence. Depending on who you speak with, you'll hear that anywhere from 10% - 40% of ALL drivers are uninsured! That's certainly reassuring!

Specifically, it would help if we knew what state you are from, as each state has different laws and rules regarding mandatory and available coverage, what to do if you're in an accident, the rules about insurance and financial responsibility, etc.

IF you have Uninsured Motorist Property Damage, or "UMPD" coverage on your policy, it is specifically designed to take care of damage to your vehicle caused by an uninsured driver. Only certain states have this coverage available, and in addition, it's usually limited to a certain dollar amount maximum as to how much is covered. $10,000 is common, and you will have a deductible attached to this coverage.

Without UMPD, the only options you will have would be to claim the loss under your collision coverage, but again, there's a deductible. Your only other option would be to sue the uninsured driver and OWNER (if different from the driver) of the vehicle.

If you give us some additional information, such as what state and what type of coverage you have under you auto policy, we may be able to get a little more specific for you! I hope things work out!
