She was the passenger in a friends car, The friend was driving when she lost control and the car rolled, so it was her fault. My daughter was wearing her seat belt. She has back injury ,stiffness and soreness, she can't bend over to pick up objects. Is going to Cosmotology school and is limited to her standing time. She is unable to work because of injury and has no incoming income at this time. she is 19 years of age.

Thank you Sherry! And I forgot to welcome you to the forum!

There are a few other things. Either what state are you in or do you know if your state is a 'no fault' or do you have P.I.P on your or your daughters auto policy? Does your daughter have her own vehicle? If not is she a member of your household?

Good thank Heaven!

Has she been the doc/hospital etc? Has there been a diagnosis, and any treatment or any forthcoming? Or is it a soft tissue thing that should resolve it's self with time? How long ago did this happen? Have you been contacted by her friends insurance company? Have they made any sort of offer of settlement?

First if you haven't you should report it to hers/your insurance company see what coverages are availabe for her medical bills. Either PIP or med pay, neither can cause a rate increase (in all state's I'm aware of).

If you live in a no fault state then yours/her insurance HAS to handle her injury unless and until it reaches the thresold. If the thresold is not reached then there is no injury settlement from her company.

A bodily injury settlement will most generally include loss of wage.

B.I. settlement also are not settled until the injured party has been released from the doctor.

Little more info Sherry and lets see what we can do. From what you've said so far, I (personally) wouldn't hire an attorney for this small of a claim.
