auto accident question

Senerio, In front of me is a 2 car accident. Someone from another car gets out to help 1st accident victims, I come up on the accident and its dark and cant stop in time, and hit the pedistrian who is helping. I'm not the cause of the original accident and I'm 21yrs old an my vehicle is under my parents ins, what exposure is this to my parents? I'm not at fault. what if the pedistrian sues me? does liability go back to original accident or am I responsible? Car is my & my dads name. If i'm sued in any way do I sue the people who caused the accident? Can my parents lose everything? I'm not at fault.

You ran into him and you think you aren't at fault? Unless you have really shoddy headlamps or the road was VERY poorly lit, there is no excuse for not seeing him. I can see for miles along the freeway outside my house.

We'll need some more details, like what kind of road it was, be it a forest route or a freeway, if there was a sharp corner, how far he was out from the road, speed limit and your speed... More details we have the better

We'll also need to know if you have a license, considered a recognized driver of the car and if you had permission to be driving it as well.

Hopefully you are a listed driver or will be considered an insured driver under the policy...hopefully again, that your BI (bodily injury) coverage limit is high enough to cover the injury suffered by the pedestrian...

if you are an insured driver under the policy the insurance company will provide a lawyer/defense...if that becomes necessary but more than likely will be able to settle the poor ped. claim without going to court...

These are two separate accidents...the first one and the one you caused....they will be handled as such...doubt very much if the first wreck will be pulled into this...(coverage wise)

doubt number one it will come to this, and number two that you could/would get anywhere with this.....

Honey you keep saying this...but you are...I think more than likely this is a defense mech. you are displaying...I'm sure you are totally freaked the hell out right now....try to calm down, a little...I'm sure you feel just awful about all of this...

first did you call your company and report this? if not DO IT RIGHT NOW!

Then in an effort to provide you more assistance, we need the following:
What state are you in? what if any tickets did you get? how hurt is the ped? what exactly was the other accident? road...what was it, highway in town, speed limit, time of day, weather conditions, your speed, see where i'm going? we need (as quenlin stated) more information...what are your BI (bodily injury) limits on the vehicle you were driving.

it's gonna be ok, and i 'think' (depends on the peds injury and your limits) mom and dad are gonna be ok...just get us the additional info....

Oh my what a mess, you sound all shook up and have a right to be, you came to a good place to get information. answer the questions asked of you and you will get honest straight forward advice, but you must be honest to get the good advice.
