Same insurance but different names on title, car totaled

Hi Me and my cousin are both named insured on my policy, i got in a accident, not my fault the other person's insurance Allstate is paying the check for it is totaled, however the car is under my cousins name. What will happen? they already have the value of the car and are about to issue the check, but the title is in my cousins name?

they will pay the owner of the car. if its in your cousins name alone thecheck will go to him.

Hi...in my belief all state is covering for both of you guys since you both were named in the policy (irrespective of whos the policy holder). Now, what do you think they are covering you for...they're covering you for a car. Had it been your car the check would have surely come to your name...at least thats what I gotta belief!

Frankly honey I couldn't identify any problem in your post. You had an accident and the insurer is about to settle the claim. You were enlisted under your cousins insurance and were authorized to drive his car.

Do you want the check in your name?

If so, then it's not possible. Under normal circumstances the insurer will write the check to the title holder of the vehicle (in this case your cousin).

Do correct me if I have read you wrong.

partially,

incorrect it it is totaled and their is a lein...the draft (doubt it's a check) will be issued to either the lein holder ONLY or the owner and lein holder...if there is a balance, then that balance will go to the owner of the vehicle.

YOUR insurance policys have no affect on this particular claim/situation since the other carrier is handling everything, at any rate.......
