1. What is the difference between stacked and without stacking?

2. How is underinsured motorist coverage accessed, when does this come into play. If my medical bills exceed their bodily injury limits, then can I access the underinsured on my policy or the other persons policy?

3. If my injuries exceed the other person's bodily injury and all other accessable parts of their policy, can I access my own, will they step in and pay the difference.

With all these questions, I have full tort and the accident is ruled the other persons fault.

I know this is a pretty wide range of questions, but I am trying to help out a co worker who is not internet literate.

1. What is the difference between stacked and without stacking?

Stacking means you can 'stack' certain coverages from all of your policys thus increasing the limits...for instance you have three policys with 25/50 UM limits, if stacking is allowed your limits can turn into 75/150 per accident...if not allowed, then they remain 25/50...

Yes, UIM is in YOUR POLICY ONLY if you have underinsured motorist coverage, and you are injured by an insured person, lets say with 25/50 limits and your injury (not your bills) is assessed or valued OVER their limit of 25k then underinsured motorist coverage can kick in...lets say your UIM coverage is 25/50 as well, your injury is determined to be 30k...at fault party pays their 25k limit your carrier pays 5k utilizing your UIM coverage...

ONLY if you have UIM...well or medpay on some medical bills too I almost forgot about that.

With all these questions, I have full tort and the accident is ruled the other persons fault.

It would have to be (full tort) ...otherwise you would be using your policy as you would've given up your rights to pursue the other guy having signed away your right to sue right ? unless it is defined as a severe injury and I never did find that definition, I'll have to look again...

Hope this helped if not you know where to come girl! others will weigh in too I'm sure....these 'choice no fault' states really give me a headache...but i think i have this correct....wouldn't hurt to double check with the DOI or as I said others will hopefully weigh in as well....

So, if my total medical, loss wage, pain and suffering attorney fees and everything else comes to $30k, but other person person only has 15/30 on their policy for coverages, can I then access my own insurance to recover the other 15k that is still missing from the total case value? NO! attorney fees don't figure into anything except out of your settlement.....

Yes if you have UIM coverage assuming you would have at least 15k UIM limit to cover the balance if you only had 10k UIM limit then that's all your could get see? even if claim was valued at 30K, unless (drum roll please) you can stack your UIM!

I am sorry to ask this again in a little different way, but I know you will break it down girl in understanding terms for me.

Now just an estimation please, is there a way to estimate case value, if you were pmed the information on the injuries?

no, I wouldn't you have to understand the mounds and mounds of material (medical) that the adjuster goes over prior to an offer of settlement...really....and all states, even regions have their own 'values'....so I wouldn't be able to do you any good, nor would I want to hazard a specific guess....I dont' mind telling people if I think they have a limits claims or something less specific...or that aggrivating a pre-existing injury isn't as valueable as 'causing' an injury, but don't want to get into trying to specifically evaulate individual injuries....besides your guess is likely as good as mine! and I'd get NOTHING else done! :P if your friend has an attorney they are paying them for that knowledge (what the claim is worth), and they too would know the area much better...sorry just don't think I could be assistance in that way....
