rental car accident

i got into a rental car accident (the car actually flipped) my insurance is refusing to pay for the damages done to the rental car, I didn't take out extra insurance i am only a part time worker and a student, could i be sued. could i sue for the medical damages, (whiplash, ache back etc)? Thanks

Please explain How? Was there any other car involved in the accident? Which insurance you are referring to, the renter's insurance or the auto insurance?

could i be sued.

I'm assuming by 'extra insurance' you are referring the 'rental car insurance'. At times, you may don't even need to take out an extra policy for the rented vehicle, your existing auto coverage will apply to the rented car. The liability coverage of your policy will cover the damages caused by you. However, the damages to your own car will be covered by the collision coverage of your policy. Therefore, you need to flip through the pages of your policy document to find out the exact verbiage and most importantly see whether you have the collision coverage at place or not.

I'm not sure though, but you can receive coverage for your injuries if you have the medical coverage attached with it. Also your health insurance should cover the medical expenses. Have you tried any of these options?

However, if you are referring to the other party's injuries then they may sue you depending upon your state laws. :)

OP we need much more information, EXACTLY what happened in the accident...EXACTLY why is your carrier denying coverage...etc..

Normally your primary insurance will extend coverage to a rental if you are in a covered territory(US, Canada). The coverage would be based on your normal insurance. So for example if you only had liability coverage on your regular auto then that's what would be extended to the rental. So in that case they would be correct in not covering the accident. If you had med pay coverage on your normal insurance, that would follow to the rental. A lot of people skimp on this coverage because they have medical insurance, however a lot of health plans come with a hefty upfront deductible.

Correct...The rental companies that I deal with ALWAYS require proof AND verification of coverage, in the case of liablity only (again this is with ERAC and Hertz primarily), they REQUIRE the renter take out ''their'' coll/comp coverage...I think there is more than likely more to the story on this one than meets the eye...perhaps the driver?
