Rear-ended by someone who claims to be rear-ended first.

I was rear-ended by a woman a few weeks ago. She is now claiming that she was rear-ended first and that car bumped her into me. She did not indicate this at all when we exchanged information after the accident - she seemed perfectly willing to accept responsibility at the time. What can I do now?

More that likley this won't change anything ''for you''...Have you filed a claim with her carrier and yours? If not you need to do so...I would file it with her carrier, but put mine on notice...unless you'd like to use your collison coverage (assuming you have it) then let your company fight this out with her and her company.

Were the police called? Is there a report? If she was rearended, then ''surely'' she got the information on the vehicle that hit her right? (I'm smirking)....Let us know all the facts, the interaction with the insurance companies and we can be of greater assistance to you.

in most states the other person is at fault.this also brings yur deductible into play. yourscould be waivd, if the person that hit you states they have been hit from behind,same thing applies. also at less than 50 percent at fault of accident

Not sure who you are referring to as the other person.....but our OP's deductible will NOT come into play unless the person that hit her's carrier for some reason refuses to pay our OP's claim, or our OP choses to use her collision coverage...

If she uses her collision coverage her deductible will NOT be waived, the other carrier may step in and pay it up front but it WILL NOT BE WAIVED.

I'll assume you are talking about a comparative 49/51% rule state, which all are not, and we do not know that our OP is :wink: So this also isn't correct...sorry.

Another good reason to take photos of the damage. An unmarked bumper will trump any rear-ended claim.
