Can insurance refuse to evaluate claim

I have been posting about my claim against my landlord insurance. I sent all my medical bills and records and supporting documents to the insurance co. Now they say they cant evaluate my claim bc i didnt sign medical authorization form. Could they do that? I live in ny.

What do they mean by medical authorization form? Could you give more detail on what happened? How was you hurt? I would think if you were hurt on your landlords property that they would pay the claim. Hang out, some one will come along here shortly who works in the industry and help you out, I wish you luck with this.

I would ask them to send you a medical release form. By rights if they are responsible for payment they must send you one. Usually even though you send them copies of the bills they will still need copies from your doc. Don't know why just know they do. If you already paid these bills once they get copies from your doc they should be able to reimburse you.

I am thinking on the same note as you fireyone, I think that they will only take the documentation from the doctors office because of authenticity, some people may mess with the paperwork, so when it comes directly from the doctor or caretaker the insurance company knows that they are getting the original documentation that has not been altered. I would think that as soon as they recieved these documents that they would review it and release the payments. goodluck, hope this resolves itself soon for you.

We all must relize just how much insurance fraud and things are out there and doctoring documents has probaly been done time and again. Its not that the insurance company doesn't trust you..its more like once you been burned. It is better off done this way anyway cause if there would happed to be any errors at least it woukdn't be on your end and your less likely to be held accountable. I would definately request duplicates of what the docs affice sends to the insurance company just to be sure I was getting reimbursed for all the out of pocket expenses. With the price of medical, one missing bill could add up quick.

Yes they can, the med auth release is so they can get medical information regarding your injury, this comes in the form of doc.records, er records, doc reports, i've even asked specifically for nurses notes before, read the form closely make sure it is to release medical info only re: you accident...they need to gather all pertainent data to evaluate your injury claim...this is common and customary and nothing at all illegal about it.

It also wouldn't hurt to get yourself an atty. That way they can deal with most or all of it. There is alot of things we are self do not know but they are trained for. Hope you take the advice you get here. Good luck.
