I was in auto accident a little over a month ago,where the other driver was at fault but her insurance company is taking thier time with decideing if they are going to take liability or not/ in the mean time I need them to pay for me to get a rental. WHile the investigation is pending. Is it smart for me to get the rental with the claim number (pending) and take the risk of them not taking liability and paying for the bill later?
By the way the accident involved the other driver running a red light and crashing and totaling my car because an ambulance was behind her,and she felt she had no choice. How can they not find her at fault?

It's up to you if it's better to get a rental car and roll the dice on liability. I don't see that anyone can make the decision for you. If you don't get a rental and they accept liability, they would still owe you for Loss of Use.
As far as liability, you already have a thread on that. I don't know that it's best to rehash it here. |

The claim number isn't going to help you, the rental car company will set it up as a self pay unless and until the carrier calls and changes it after the investigation is completed.

If you do end up getting a rental car, at least have your insurance company call the rental car place and get you their rate. Mine was only $26.50 per day since Nationwide called ahead for me. Probably would have been upwards of $50/day otherwise.
