I was involved in a MVA on October 1,2007 in Springfied, Mo. I was rearended as I was sitting at a stop light and then pushed into a truck in front of me. Upon initial impact I had no idea what had happened. I was so stunned. Anyway, turned out that I was rearended by a former patient that I had rehabed from Physical therapy. Crazy coincident!! This gentlemen was given a citation for hitting 2 parked vehicles. Anyhow, I was not taken to the emergency room because I initailly thought I was just shooken up. There were $3000 worth of damage to my car. Later on that day, I started feeling dizzy and I just couldn't hold my head up. I went to the ER that afternoon and was dx with a cervical strain. That night, I started getting really sick. I vomitted for the next 24 hours. I went to the ER the following night and was dx with a concussion following MVA. It has been 7 months since my MVA and still no settlement offer. I initially tried to get a lawyer and ended up feeling like I was going to get screwed!!! I felt that my concussion and other injuries were worth more to them, than to me!! Although my health insurance paid for most of the bills, I still have a balance of $300 at the hospital that went in to collections. I have paid the bill that went into collections so that my credit wouldn't get messed up. How long should this take and how much of a settlement should I expect? Is the above mentioned treatments all that you have had? No P.T. or anything? If you have completed all treatment then you need to contact the adjuster and let them know that you have finished and are now ready to discuss settlement of your injury claim... They will need to request all of your medical records...you will have to sign a medical authorization if you haven't already...once they have all the info they will be in a position to offer you a settlement....When was the last time you talked to the adjuster? Or does the adjuster know that you went to the hospital later that night and were injured (man I hope so) If not you need to let them know right now! I did see a neurologist because I was experiencing dizziness nearly everyday, and she told me that I would probably experience that for up to a year. I am a physical therapist and the dizziness subsided as time went on so I really did not need physical therapy. I have signed medical release forms and the adjuster did know that I went to the hospital for a second time. The last time I spoke to the adjuster, around the begining of April, she said she was waiting on an itemized statement from the hospital. She said that she would call me as soon as she received it. No call in 3 weeks. I called her on Monday, April 28th in the afternoon, to see if she had received all the info she needed. Just left a message and no reply since. I am getting a little aggrivated. I just want to be compensated appropriately and get on with my life. What do you think is an appropriate compensation in my case?
First I would call her again and leave a message today, if you don't hear from her by end of today then call back if her voice mail picks up hit zero that will usually route you to someone then ask for her supervisor and tell them you have been waiting three weeks plus to discuss this...if that doesn't do any good ask for the claims manager, and so on....
re: compensation it's really not possible to figure that out (from here) without seeing all the medical information, doc reports, nurse notes etc....
They owe you all your medical bills, any loss of wage, mileage to and from the doc and compensation for the time that you were not feeling well...figure out what you think that might be worth to you....if this was basically a minor soft tissue and a concussion...the concussion will boost the 'value' some...personally as the injured party I would want the adjuster to make the first offer then think on it awhile...she should've evaluate the injury and come up with a 'range' she will offer you the lower portion of that range in her first offer (or should)....
Make sure that you discuss the bills making sure she has all of them, and if she will be paying them direct or if you are to pay them out of your settlement....

Ok...so it has been a few weeks since I posted this and I have finally received a settlement number...AND IT SUCKS!!! What crap!! ok..here is the break down of the numbers... I lost 3 days of pay= $513. Net medical bills= $1,398. Grand total= $1911.00. They are offering me a grand total of $4000. So subtract the $1911 and that is only $2089 for my pain and suffering with a cervial sprain and a concussion!!!! What do I do now??? Am I over reacting?? Is this average settlement?? I was thinking more than that!! Hello....CLOSED HEAD INJURY!!! Oh my...i need some more advice!!!
You say this is the 'net' medical...what does that mean ? Unless your state has some other rule/law they would owe you the full amount of the bill (or negotiated bill)....Please explain that part...also remind me what is the prognosis, and the diagnosis was concussion right?
