No Police Report but was claimed to the Insurance

I was in heavy traffic. I was pulling forward and he was going backwards. He had a scratch that was maybe 2 inches long. I had no damage. You can't even tell that I hit him. We took each other's information and he said that he had paint in his garage. No police report was filed. The next morning I got a phone call from our insurance that there was a claim filed. Can the claim actually go through? Without any true evidence on my vehicle and no police report. I did take a picture of his scratch. What should I do?

Anyone with your insurance information can file a claim. Legally the other person needs to prove you were at fault but your adjuster would also investigate the claim and make their own determination.

I'm guessing traffic was stop and go. If so, why would the other person starting backing up on the roadway? This is highly unusual and almost never happens. However, it's common for vehicles to rear ended others in stop and go traffic.

Of course.

I did take a picture of his scratch. What should I do?

Tell the truth...If you were negligent you owe the guy for the scratch that's all there is to it...why would you not want him compensated?
