How long does it take

Finally my atty seems to getting ready to settle my case. They informed me they had more than enough to get a settlement. Now my question is how long does this process take? They were in the process of gathering the last of my records. My family doc sent their records to my atty back on May 9 and the Regional pain facility I am still doctoring with (RSD) has sent their records recently also. The atty said once they got all this they would prepare a report to send off to the adjuster and wait for a response. Work is not working out for me very well and I am losing the battle of bills and struggling to stay a float. I would just like to know when I can approx. know anything. I asked the atty and they said they would contact me when they heard anything.

The attorney can put a response time in the demand letter but I don't find that many do. The shortest time I've seen is 10 day... and when I've seen that, I've asked for an extension. Typically I see attorneys ask for a response within 30 days and there is really no reason for an adjuster to take longer then that. Most states have guidelines that state most responses should not take longer then this.

I asked the atty and they said they would contact me when they heard anything.


It is understandable...but, please do remember that it is your problem..so maintain a time frame post which you have to knock their doors ( I mean follow it up through a phone call may be..)

The settlement doesn't always depend on the atty my dear, it is sometimes up to the adjusters to process the claims request (which may take considerable time in case they feel there is some data missing at the records or if it requires further investigation or analysis) in time. Hope everything works for you!

As tcope mentioned some times (in my area nearly always) there are time lines set out on both sides...Generally when I would receive a demand an attorney would send a huge packet then say somewhere in the letter, ''We want 10 ga-zillion dollars, this offer of settlement is good till June 30th (for example) and will be withdrawn after that' Then the adjuster writes back, and eventually says in their letter, 'We are offering five bucks to settle your clients claim, this offer is good till July 30th, and will be withdrawn after that date'...your attorney writes back...then eventually (some at the on set) the atty and adjuster start talking on the phone and get an agreement, after the adjuster makes offers then the atty has to talk to you, and get back with the adjuster etc. It really depends on how far apart each party is, and how quickly they can find common ground. I've seen them settled after the first contact, and I've seen this back and forth go on for months and months.

Thanks everyone for your quick response. I am hoping this doesn't drag out but I also want a fair deal. I just need to rid myself of some of this stress. Almost everyday I wake up with a headache and sick to my stomach with worry. I thought I could catch evrything up with working and it is just alot more difficult than I imagined it would be. I am also having a hard time dealing with that fact.
Will the atty contact me with each offer or only when they feel they have a reasonable offer? Thanks again.

Yes, your attorney should contact you with each offer, unless maybe you have already set a minium with him/her...

I didn't set any min. I have never even been through this in my life so I didn't know I could do this. I did inform them that I would like as much as they could get. The amount use to not matter too much before...when I thought this was just a short detour..Now that its something that can't be fixed and I am reminded everyday by my limitations and pain I have a different outlook. I hope this sin't sounding greedy because I am not. I would be the first person in line to help anyone (even a stranger)out.
I am now just praying for this amount to be decent and to get rid of this financial stress. I tell ya Lori..I don't think I have ever been under this much stress in my life. Talk to ya soon. Again thanks.

Finances just suck! We've all been there (well most of us) at one time or another, when I had small kids and was a stay at home mama my husband was the only bread winner, it was the recession of the eighties, and we didn't have too much to begin with, and he broke his jaw playing in a soft ball tournament....was supposed to be off work (per doc) 6-8weeks (was in the hosptial for seven days) he went back in three (because he had too and he's just that kind of man)...still three weeks with NO money was horrible! and I thought we'd never crawl out of that hole....I totally understand...hang in there....you're in our prayers...

Finances definately suck. I don't think it would be nearly as bad if they would do something about these darn gas prices. They are effecting everything. I can't even get my front yard..well not a yard..a mud hole, finished off so I can plant grass. The gas prices are soo high that the excavating companies are doubling prices. I totally understan d why they are..still it stinks.
Anyway I'm holding on the best I can. Ya know I was probaly about 10 years old and I actually remember the eighties recession. I also remember it being hard on my family too. Boy I sure hope this newest crisis passes soon.

well I spoke to the atty office today and they informed me that they have to sit down and go through everything. I asked when I could expect this case to settle. I asked 30-60 days? The assistasnt said she doubted it. I told her I wasn't in the finacial situation to be waiting for them and she said she would speak to the atty and put a rush on it. (she probaly will forget). Why is it going to take so long if they already have all the records?
