I fractured my elbow in an auto crash. The car was totaled

The car that hit me ran a red light. The teenagers did not have a license or insurance. My air bags deployed, I did not go to the hospital in the ambulance, but was taken there by my husband. I missed a few days of work and could not work out for 6 weeks. I am 50+ years old and am having some discomfort with my arm. I am meeting with the insurance adjustor tomorrow and would like to know the average rate of compensation for this injury.

Well...the question is...who is going to compensate you. Much of that will depend on the type of coverage you have and the state that you are located in.


I assume you have PIP or medical payments coverage. Unin. mot. protection will help, although you will probably need a judgement.

Also...not "working out" is a lot different from not working.

A person does not need to file suit for UMBI (uninsured motorist bodily injury).

OP, it's impossible to answer you question. Some of the information a person would _have_ to know is, what state the accident happen in, review of all your medical notes/records, review of the billed amounts, etc. After all of this was reviewed, a guess would be possible.

A true fractured arm is a little more then a soft tissue injury and it's possible that it will never fully heal (though, the usually will). Also, you are 53 so it's less likely that this will affect you as much or as long as someone younger. These are a few other things that would be considered.

Yes, you didn't quite mention about the worth of the medicals bills!
Again you didn't mention about the kinda coverages that you possess!
Please explain a bit more in this regard in order to let us arrive at a realistic figure. It was truly painful..& I'm sure you'd find some time to help out similar other people at the forums once you're out of the mental agony that you're going through. Pray everything goes in the right direction for you!

All I can say, that 'discomfort' may not signify anything to the adjuster. She would insist to know the exact nature of the injury. Therefore, get yourself diagnosed by a med. to determine the nature of the discomfort.

I was always told it is three times your medical bills but was recently informed that is not the correct way of figuring it out. There is suppodely four values that can be put on a claim- Low value, core value, mean value and premium value. Plus your lost wages and any out of pocket expenses are figured in. I am far from and expert on this. You may benefit from an atty. but if the injury wasn't severe it may just eat up some of your settlement. Good luck.

There are so many variables that come into play while trying to decide the proper compensation to seek. You should most definitely seek professional medical assistance on determining your injuries. You say you have a fractured elbow but seem to base that on discomfort. It could go either way. Could be better or worse than you expected.

I think alot of it has also got to do with the length of your injury and how much pain and suffering. This could or should have been noted by any doc that seen ya. Hope you feel well soon.
